What do these permits involve in Seminole County?

Zoning Approval of the Business Location (Unincorporated Seminole)

The Seminole County Tax Collector's 2025 Business Tax Receipt Application states that "Prior to obtaining a Business Tax Receipt from Seminole County, all commercial and residential business located in unincorporated Seminole County must receive approvals from" the Planning and Development Division "to check zoning requirements for your location" (407-665-7371), the Building Division to determine whether a permit is needed for modifications or a change in occupancy (407-665-7050), and the Fire Department for a fire inspection. The same form states that post office boxes, private mailboxes and virtual offices may not be used as the business address, and that when a residential address is the business location, Seminole County zoning rules require the owner to reside there and provide proof of residency such as a driver license, utility bill or lease. The Building Division's Guidelines for Change of Use likewise begin with confirming that the property is zoned for the proposed use, through the Planning and Development Division (plandesk@seminolecountyfl.gov). This step applies to locations in unincorporated Seminole County; a location inside one of the seven cities follows that city's zoning.

County Local Business Tax Receipt

County Code Sec. 45.1(a) levies a local business tax for the privilege of engaging in or managing any business, profession or occupation within Seminole County. Under Sec. 45.2, a Class "A" non-regulated business, one that needs no federal or state license, certification or registration and is not regulated by any other county or city ordinance, pays $25.00 a year; a Class "B" regulated business pays $45.00. One receipt covers each business location even where several activities are carried on there, and the location takes Class B if any one of its activities is regulated (Sec. 45.2(c)); new Class B applicants must produce their federal, state or local licenses before the receipt is issued (Sec. 45.2(d)). The Tax Collector's Business Tax Receipts page publishes the same $45.00 and $25.00 amounts. A restaurant, salon, contractor or child care centre holding a state license is therefore Class B. Under Sec. 45.1(a), a receipt issued after October 1 but before April 1 pays the full annual tax, and one issued after March 31 but before October 1 pays "one-half the annual appropriate local business tax, provided no delinquency exists." Sec. 45.1(b) adds 10 percent for an October renewal and 5 percent for each later month up to 25 percent, a 25 percent penalty for operating without a receipt, and a $250.00 penalty for failing to pay within 150 days of the initial notice. The Tax Collector's FAQ states that if the business location is within city limits a city-issued business tax receipt is required as well, and its page advises businesses in cities to check the city's requirements. For a location in unincorporated Seminole County, the Tax Collector's 2025 application requires the Planning, Building and Fire approvals recorded separately. Tax Collector: 1101 E. First St., Sanford (407-665-1000).

Commercial Building Permits (Unincorporated Seminole)

The Seminole County Permit Fee Schedule, Revised October 2026, linked as the full fee schedule from the Building Division's New State Legislation Affecting Permits page, states that the county's permit fees are based on "actual cost of service" as required by HB 803 and that the fees "are temporary based on Resolution 2026-R-61 approved by the BCC". The Board of County Commissioners' Legistar record shows Resolution #2026-R-61, authorizing the Building Official and Development Services Director to adjust permitting and development fees to match state law, approved on June 23, 2026. The county's page adds that the schedule reflects interim updates, that the county is conducting a comprehensive fee study and that additional fee adjustments may be made on its completion; it also notes that from January 1, 2027 development application fees must be based on the actual cost of review under HB 399. The schedule applies a $75.00 administrative fee to all permits unless otherwise noted, gives each commercial permit three free re-inspections or partial-pass results before re-inspection fees apply, and doubles the total permit fee for an owner-builder (triples it for a licensed contractor) as a stop-work-order penalty. The county's Building pages announce that online permitting is moving to the county's new OneStop system, launching October 19, 2026, with in-person and phone service available. Under F.S. 125.56(1) the county enforces the building code outside the corporate limits of any municipality, so these permits apply in unincorporated Seminole County; a site inside a city is permitted by that city. Building Division: 1101 East First Street, Sanford (407-665-7050).

Change of Use or Change of Occupancy Permit (Unincorporated Seminole)

The Building Division's Guidelines for Change of Use or Residential to Commercial (Revised 04/10/2024), linked from its Forms & Applications page, set out what is needed to obtain a building permit for a change from one commercial use to another or from a residential use to a commercial use. The property must be zoned for the proposed use (the Planning and Development Division verifies zoning at 407-665-7371), an approved site plan is needed if site alterations require one, a building contractor is required, and plans must show how the space will comply with the new use, sealed by a Florida-licensed architect or engineer where structural work or fire-rated assemblies are involved. Plans must show existing and proposed floor plans, code criteria, construction type, sprinkler status, previous and proposed occupancy, adjacent occupancies and fire-rated separations, and the proposed use must meet the change of occupancy provisions of the Florida Building Code – Existing Building. The guidelines recommend a pre-application meeting with the Planning and Development Division. The Tax Collector's 2025 Business Tax Receipt Application sends a new business in unincorporated Seminole County to the Building Division to determine whether a permit is needed for modifications or a change in occupancy (407-665-7050). This applies in unincorporated Seminole County under F.S. 125.56(1).

The Seminole County Fire Prevention Bureau's page states that it enforces the Florida Fire Prevention Code and local laws adopted by the state and county, and that it provides its services to unincorporated Seminole County and the City of Winter Springs. Its services include development reviews of site plans, plans review for new construction and fire protection systems, acceptance inspections before occupancy or use, and State Required Fire Inspections for business owners who operate adult care facilities, child care facilities, private schools, transient public lodging and public food service establishments. The Bureau's Fire Inspection Requests page offers a Business Tax Receipt (BTR) inspection request and states that BTR inspections "are required periodically or when opening a new business", and that annual inspections are required for licensing, accreditation or other regulatory requirements. The page also states that all unpaid re-inspection fees must be paid before a fire inspection can be scheduled. The Tax Collector's 2025 Business Tax Receipt Application tells a new business in unincorporated Seminole County to schedule a fire inspection by calling 407-665-7422 or emailing scfdinspections@seminolecountyfl.gov.
