What do these permits involve in Polk County?

County Local Business Tax Receipt

Polk County levies a local business tax for the privilege of engaging in any business, profession or occupation within Polk County, and County Code Sec. 9-133 applies it "within all areas of Polk County," so a business inside Lakeland, Winter Haven, Bartow or any other municipality owes this county receipt as well. The amounts are as set in the County Code: Sec. 9-137 (Ord. No. 09-070, as amended by Ord. No. 15-006 on January 20, 2015) sets $31.50 for Class A, $57.75 for Class B and $315.00 for Class C. The Tax Collector's penalty page computes its delinquency amounts on the same $31.50, $57.75 and $315.00 base. The Tax Collector's Local Business Taxes page lists $39.38, $72.19 and $393.75, which are exactly 1.25 times the code amounts, and Sec. 9-143(b) sets a penalty of 25 percent of the tax due for non-compliance; contact the Tax Collector to confirm the amount charged. Per the Tax Collector's penalty page, a renewal paid after September 30 adds a penalty of 10 percent in October, 15 percent in November, 20 percent in December and 25 percent from January through February, each with a $10 collection cost, and 100 percent with a $40 collection cost from March 1. Sec. 9-143(c) makes failure to obtain the receipt within 150 days after notice a misdemeanor with a $250 fine. A Class B applicant must exhibit the required state license, certification or registration before the receipt issues (Sec. 9-137(e)). Under the Tax Collector's Technical Advisory 11-02 (revised May 24, 2018), a food business must exhibit a current state food permit or exemption letter before the receipt is issued or renewed, a food business that needs a state license takes a Class B receipt, and one that does not, such as a cottage food operation, takes Class A. The application's list of activities includes codes for restaurants, coffee shops, mobile food vendors, retail, child care, contractors, auto repair, veterinarians and salons and barbers. The application's sworn statement says the receipt does not indicate that the parcel is properly zoned for the activity.

Building Permit (Unincorporated Polk)

The county's Building Permits page links the Construction Fee Schedule, Resolution No. 17-025, adopted by the Board of County Commissioners on April 18, 2017 and effective July 3, 2017. That resolution reaffirms the Growth Management/Building Inspection fees of Resolution No. 07-099-A (September 12, 2007), as amended by Resolution No. 07-116 (October 10, 2007), changes commercial electrical, plumbing and gas permits to contract-value fees, and states in Exhibit A that all construction permit fees are due at permit issuance. The building permit fee is a building-permit-only fee based on the valuation of the work, with a commercial/industrial table starting at $102.00 and a residential table starting at $85.00 for work valued up to $12,000. County Code Sec. 5-12 describes the county's construction code amendments as providing for safe construction of any building in the unincorporated areas of the county. Applications run through the Polk County Access Portal. A business doing a build-out or new construction should confirm the permitting authority for its address, since a site inside a municipality falls under that municipality's own building department.

Onsite Sewage Treatment and Disposal System (Septic) Permit

The Florida Department of Health in Polk County's septic page states that DOH-Polk "inspects, evaluates, and permits the installation of all new and repaired septic systems in the county," that permits must be obtained from the health department to install or repair these systems, and that only registered septic tank contractors or licensed plumbers may work on them. The same page states that from January 2, 2025 the Florida Department of Environmental Protection manages septic permitting in 16 named counties, which do not include Polk, and that outside those counties the local county health department still handles septic permitting and inspections. Septic tank permits are obtained at the Bartow Environmental Public Health Office, 2090 E. Clower St., Bartow (863-519-8330). The page publishes no fee amount, so this record gives none. This applies to a business whose premises use a septic system rather than a public sewer.

Well Construction Permit

The Florida Department of Health in Polk County's Well Permitting page describes well construction permitting as a two-part process involving the health department and the Southwest Florida Water Management District, and links to the District's well construction permit application. It directs applicants to contact the DOH-Polk Water Program to schedule a pre-construction site inspection before drilling a public drinking water well, to verify that the proposed location meets setback requirements. The same page states that well drilling in eastern Polk County is handled by the Florida Department of Health in Osceola County. The page publishes no fee amount, so this record gives none. This applies only to a business that drills a well for its premises.
