What do these permits involve in Brevard County?
Business Tax Receipt Transfer (new owner or new location)
The Brevard County Tax Collector's Business Tax Receipt information page states: "A TRANSFER FEE of $3.70 is applicable." That figure equals 10 percent of the $37 annual receipt fee, the formula Fla. Stat. s. 205.033 allows for a transfer (up to 10 percent of the annual tax, with a $3 minimum and a $25 maximum). The Tax Collector's Business Tax Receipt page says a receipt may be transferred to a new owner, on an online application with a copy of the bill of sale and payment of the fee, or to a new location, and that the application should be made within 30 days; a business that keeps operating after 30 days without transferring is subject to the same penalties as doing business without a receipt, plus the full amount due for each classification. Individual professional and exempt receipts cannot be transferred to a new owner, per the same page. Before a transfer to a new location, the page tells the applicant to check prerequisites with the State, county and city agencies concerned, such as the State license, building occupancy, zoning, a city receipt and health inspection.
Brevard County Local Business Tax Receipt
The Brevard County Tax Collector's FAQ states that Business Tax Receipts are issued under Chapter 102, Article II of the Brevard County Code, as authorized by Chapter 205, Florida Statutes, and that any person engaged in or managing any business in the incorporated or unincorporated areas of Brevard County requires a receipt, with a receipt required for each location and for each person in a professional classification. The fee is $37.00 per year plus any penalties, as published on the Brevard County Tax Collector's FAQ page; the Tax Collector's Business Tax Receipt page also refers to the $37 annual receipt fee. The same FAQ answer says that, depending on the type of business and the location, an additional Hazardous Waste surcharge and/or Fire Prevention fee may apply. The Business Tax Receipt page quotes County Code Section 102-28 as the levy, states that the Local Business Tax is levied by Brevard County and municipalities, and tells a business located within a municipality to contact that municipality for its requirements. It also tells a business in the unincorporated area to contact Brevard County Zoning (321) 633-2070, Environmental Health Services (321) 633-2100 and Development Services (321) 633-2072 before applying, and says a business regulated by a State board must present its State license before the receipt is issued (Fla. Stat. s. 205.194). Receipts are issued or renewed from July 1, are due by September 30 and become delinquent on October 1. The Tax Collector's page states that the fee exemption under Fla. Stat. s. 205.162 applies only to the $37 annual receipt fee.
Commercial Building Permit Zoning Review and Commercial Concurrency Review
The Brevard County Planning and Zoning Applications & Fees page lists, under Building Permit and Concurrency Fees, a Commercial Building Permit review fee of $210 and a Commercial Concurrency review fee of $175. These are Planning and Zoning review charges on a commercial building permit in unincorporated Brevard County, for example a build-out or new building for a restaurant, shop, salon, clinic, gym or child care centre. They are charged in addition to the building permit fee itself, which is not part of this record. The fee page states no effective date or adopting resolution number for the schedule. A project inside one of the county's municipalities goes through that municipality's own zoning and building review.
Onsite Sewage Treatment and Disposal System Permit — New System
A business whose building will be served by a new onsite sewage (septic) system rather than a public sewer needs a construction permit from the Florida Department of Health in Brevard County, Environmental Public Health Services, 2725 Judge Fran Jamieson Way, Suite A116, Viera, (321) 633-2100. DOH-Brevard is a State agency office, not county government. The fees are those printed in its Onsite Sewage Treatment and Disposal System Application Packet for New Systems Only, Rev 08/26: $510.00 for a new system without a site evaluation, $395.00 with a site evaluation submitted, $520.00 and $405.00 for the performance-based treatment system equivalents, and $260.00 for holding tanks, with ancillary charges for site evaluations, inspections, re-inspections, amendments and State variance applications ($300.00 residential, $425.00 commercial/multi-family). The packet asks for a floor plan; for a non-residential building it must show total square footage and all plumbing drains and fixtures. A business on a public sewer has no septic permit.
Zoning Use Permit Approval for Business Tax Receipts
The Brevard County Planning and Zoning Applications & Fees page lists "Zoning use Permit Approval for Business Tax Receipts" at $25 under Miscellaneous Fees. The page states no effective date or adopting resolution number for the schedule. This is the zoning sign-off for a business tax receipt at a location in unincorporated Brevard County: the Tax Collector's Business Tax Receipt page tells a business in an unincorporated area to contact Brevard County Zoning at (321) 633-2070 before applying for the receipt, and tells a business inside a municipality to contact that municipality instead. The Tax Collector's page also notes that issuing a receipt does not confirm that the business activity on the property complies with local zoning, so the zoning approval is a separate step. Brevard County Planning and Zoning is part of Planning and Development at the Viera Government Center.
Onsite Sewage Treatment and Disposal System Permit — Repair or Abandonment
A business on a septic system that needs the system repaired, or a tank abandoned, applies to the Florida Department of Health in Brevard County, Environmental Public Health Services, (321) 633-2100, a State agency office. Its Onsite Sewage Treatment and Disposal System Application Packet for Repair Permits and Abandonments Only, Rev 08/26, lists a repair permit at $435.00 without a site evaluation or $320.00 with a site evaluation submitted, and an abandonment at $70.00, plus ancillary charges for inspections, re-inspections, permit amendments, site re-evaluations and State variance applications ($300.00 residential, $425.00 commercial/multi-family). For a repair permit the packet asks for a completed Existing System/Repair Evaluation Form and, for a property on municipal water, water use records. A business on a public sewer has no septic repair permit.
Onsite Sewage System — Modification or Existing System Approval
A business moving into or altering a building served by an existing septic system, for example when a change of use or an addition changes the sewage flow, applies to the Florida Department of Health in Brevard County, Environmental Public Health Services, (321) 633-2100, a State agency office. Its Onsite Sewage Treatment and Disposal System Application Packet for Modifications and Existing Systems Only, Rev 08/26, lists an existing system approval at $110.00 with an inspection or $60.00 without one, and a modification permit at $455.00 without a site evaluation or $340.00 with a site evaluation submitted, plus ancillary charges for inspections, re-inspections, permit amendments, site re-evaluations and State variance applications ($300.00 residential, $425.00 commercial/multi-family). A business on a public sewer has no septic modification approval.
Written Zoning Verification
The Brevard County Planning and Zoning Applications & Fees page lists a Written Zoning Verification Fee of $37.50 under Miscellaneous Fees. A business can request a written statement of a property's zoning in unincorporated Brevard County, for example before signing a lease, or when a lender, landlord or State licensing agency asks for zoning confirmation. It is an optional service rather than a license. The fee page states no effective date or adopting resolution number for the schedule. Property inside one of the county's municipalities is zoned by that municipality.
