About each permit

Retail Food Establishment Permit

According to the Brazoria County Environmental Health Food Permitting Process page, "A retail food permit is required prior to operation and if the ownership changes", and retail food permits are non-transferrable. The page lists the documents to submit together, in person or by mail: the Food Permit Application, a floor plan, a water utility service agreement or approved well and septic information, the OSSF permit number if required, a Certified Food Manager Certificate, a Fire Marshal Inspection, a State of Texas Sales Tax Permit and a copy of the menu. New construction outside city limits must first schedule a Pre-Development Meeting with county Engineering (979-864-1265); for a permit within city limits, the page directs applicants to contact a food inspector for a consultation. Permit fees are due only after documents have been reviewed and approved and the establishment has passed inspection. On fees, the page's 89th Legislative Update says SB 1008 took effect September 1, 2025 and states: "The county is in the process of implementing these changes which include various Permit Exemptions and Fee Schedule changes." Contact Environmental Health at 979-864-1600 for the current amount.

Temporary Food Establishment Permit

Each temporary food establishment at an event needs its own permit from Brazoria County Environmental Health. The county's application packet, linked from the current Forms & Permit Applications page, says the single event permit is valid for one individual food booth or unit at one specific event, for 14 consecutive days from the initial effective date, and the form states "No Refunds for Event Cancellations". At least one person on site may be required to hold an accredited food handler certification, unless the booth is run by a non-profit or serves no food that needs time or temperature control for safety. Food must come from approved sources, and food prepared in a private home is not allowed. On fees, the county's Food Permitting Process page states: "The county is in the process of implementing these changes which include various Permit Exemptions and Fee Schedule changes." Contact Environmental Health at 979-864-1600 for the current amount before the event.

Farmers' Market Vendor Permit

A vendor selling food at a farmers' market under Brazoria County Environmental Health's jurisdiction applies on the county's farmers' market annual permit form, which is linked from the department's current Forms & Permit Applications page. The form is undated, and the farmers' market permit is a food permit covered by the county's announced SB 1008 changes: the Food Permitting Process page states, "The county is in the process of implementing these changes which include various Permit Exemptions and Fee Schedule changes." For that reason no dollar amount is stated here. Contact Environmental Health at 979-864-1600, or EHStakeholders@brazoriacountytx.gov for the department's stakeholder notices, to confirm the current fee before applying. A market inside a city that runs its own food program deals with that city.

Sanitation Inspection Report (child care facilities)

A child care center, child care facility, day care center, 24-hour care center, group day care home, child care institution or residential child care facility in Brazoria County Environmental Health's jurisdiction needs a sanitation inspection report from the department. Under Order No. 36, passed by Commissioners' Court on September 11, 2007, Article 4 sets the fee at $150 per establishment, valid one year from the date of issue, requires a separate permit for each facility and adds a $75 delinquency fee when the renewal is filed after expiration. The current Application for Sanitation Inspection prints "$150.00 Fee Applies - INSPECTION VALID FOR 1 YEAR", must be notarized, and states that there are no refunds once it is submitted; the department's fee schedule lists the same $150 a year and $75 late renewal. The Food Permitting Process page, updated for SB 1008, states: "We will still continue to offer Sanitation Inspections as normal." Contact Environmental Health at 979-864-1600.

On-Site Sewage Facility (OSSF) Permit, Commercial

A business on property served by a septic system rather than a public sewer needs an OSSF permit from Brazoria County Environmental Health. The county's OSSF Permitting Process page states that "An OSSF permit is required prior to installation of the OSSF and issuance of a Building permit", that an existing system without a permit cannot be retroactively permitted, and that fees are due only after the application packet has been reviewed and approved, when an Authorization to Construct is issued. The current OSSF Permit Application (Revised 3/22/24) prints "$450 Commercial", and the department's fee schedule lists the same $450 and a $220 commercial re-inspection; both are linked from the department's current pages. The application states it expires one year from the application date if inspection is not complete, and that there are no refunds once the permit is issued. The packet also needs a site evaluation and a design package prepared by a Registered Sanitarian or Professional Engineer, as required. A business on a public sewer connection has no OSSF trigger.

OSSF Installer and Maintenance Provider Registration

A contractor who installs on-site sewage facilities, or provides maintenance on them, in Brazoria County Environmental Health's OSSF jurisdiction must be registered with the county. The department's OSSF Permitting Process page lists among the documents for every permit that the "Installer and maintenance provider (if required) must be registered with the County." Section 10(b) of the county's OSSF order sets out the registration and states: "No fee shall apply to the registration." The same section states: "Homeowners are not required to register with the County." Contact Environmental Health at 979-864-1600 to register.
