Fire Marshal Commercial Construction Permit and Plan Review (Unincorporated Areas)
The Fire Marshal's permit policy, adopted by the Victoria County Commissioners Court on November 17, 2025 and in effect from January 1, 2026, requires permits, plan review and Fire Marshal approval before work begins on new commercial construction, commercial remodeling or renovation, tenant finish-outs and build-outs, any change of occupancy, and fire protection system work; no work may begin until the permit is issued. This is a fire and life safety permit: the policy states it uses NFPA 1 and NFPA 101 as minimum standards and "does not constitute the formal adoption of a fire code under Texas Local Government Code § 233.061". The Fire Marshal's page describes its enforcement area as the unincorporated areas of Victoria County. The county's Development & Permit Guidelines (revised January 22, 2025), which predate this policy, state that the county has not adopted building codes for the unincorporated area and "does not issue building permits or provide a certificate of occupancy". Figures are from the Fire Marshal's Building Permit and Commercial Occupancy Fees application (form VCFM-BCPA-2026-0101, effective 01-01-2026), which says a commercial permit's total is made up of a plan review fee, a building permit and inspection fee, and a final inspection and Certificate of Compliance fee; the form prints the per-square-foot construction fee and the $150 site/civil review line shown here. On-Site Sewage Facility (Septic) Permit — Commercial
The county's On-Site Sewage Facility page states that Victoria County is an authorized agent of the Texas Commission on Environmental Quality under Health and Safety Code Chapter 366, with permits reviewed and inspected by the Public Health Department's Environmental Services Division, and directs applicants to its OSSF Application Packet. That packet (revised 11/29/2022, the version linked from the page) prints the Victoria County fees as $285 residential, $385 commercial and $100 reinspection, and states that an Authorization to Construct is valid for one year from the date it is issued; after that a new application and permit fee are needed. The page says applications are approved or denied within 30 days, and a TCEQ-licensed site evaluator must assess the soil first. A business building on a site without public sewer is the case this applies to.
Floodplain Development Permit
The county's Floodplain page states that Victoria County participates in the National Flood Insurance Program and regulates floodplain development under its Floodplain Ordinance (545-2251), and that its Floodplain Development Permit form is to be completed for any residential, commercial or OSSF development determined to be within a floodplain. The county's Development & Permit Guidelines (revised January 22, 2025) state that the county issues floodplain development permits for properties in the Special Flood Hazard Area (100-year floodplain). The permit form states that the permit expires 180 days from the day it is issued. This applies only to development on a site inside a mapped flood hazard area.
Fire Protection and Notification System Permits (Unincorporated Areas)
The Fire Marshal's permit policy (adopted November 17, 2025, effective January 1, 2026) covers projects that install, modify or remove fire protection systems, and the office's New Construction Submittal Requirements list underground fire service lines, sprinkler systems, fire alarm systems, hood suppression systems and fuel tanks and piping as deferred submittals needing separate permits. Figures are as printed on the Fire Marshal's Fire Protection/Notification Systems Fees permit application (form VCFM-FPPA-2026-0101, effective 01-01-2026). A restaurant or coffee shop installing a Type I hood suppression system pays the $75 commercial cooking suppression line; an auto-repair shop installing a paint booth extinguishing system falls under the $100 automatic extinguishment line. The Fire Marshal's page describes its enforcement area as the unincorporated areas of Victoria County.
Fire Marshal Certificate of Compliance — Change of Owner or Business Name (Unincorporated Areas)
The Fire Marshal's Building Permit and Commercial Occupancy Fees application (form VCFM-BCPA-2026-0101, effective 01-01-2026) prints a $100 fee for a Certificate of Compliance (COC) business name change or change of ownership, which "applies to an existing business, if the owner's name or business name on a COC is changed from one owner to another, or when there is a change in the business name." The same form prints $25 to replace a COC and inspection report, and $75 for any occupancy not otherwise listed that requests an annual inspection.
