The county enforces the Fire Code of Kaufman County, the 2024 International Fire Code with county amendments adopted by the Commissioners Court under Local Government Code chapter 233, subchapter C; the code applies only in the unincorporated area, where the Kaufman County Fire Marshal's Office issues building permits, construction permits, operational permits and Certificates of Occupancy, and charges the fees in the code's tables headed "Kaufman County Fire Marshal Permit Fee approved Oct 29, 2024". The County Clerk signs TABC beer and wine applications and certifies wet or dry status under the Alcoholic Beverage Code; alcohol licenses and permits themselves are issued by the Texas Alcoholic Beverage Commission. TABC's county list names Combine, Cottonwood, Crandall, Forney, Grays Prairie, Heath (part), Kaufman, Kemp, Mabank (part), Mesquite (part), Oak Grove, Oak Ridge, Post Oak Bend, Rosser, Seagoville (part), Talty and Terrell in the county. Each city runs its own permit and license requirements, which stack on the state records; the county fire-code permits apply only outside city limits, and the FAQ of Development Services says Oak Ridge and Terrell handle septic permits inside their own city limits.

What do these permits involve in Kaufman County?
Fire Code Building Permit (unincorporated Kaufman County)
A business that builds in unincorporated Kaufman County needs a building permit from the Kaufman County Fire Marshal's Office. The Fire Marshal's Building Permits page states that a building permit application is required to "construct a new building, substantially improve an existing building, or change the use or occupancy type of an existing building", and that "All plans submitted to the Kaufman County Fire Marshal's Office must be stamped by a licensed design professional (architect or engineer)." The page gives the fee formula as gross square footage times the cost per square foot times .003 (0.3%). The Building Permit Fee Schedule in the county's adopted fire code uses the same formula with the ICC Building Valuation Data cost per square foot, and Step 4 states: "The minimum fee for a building permit is $500." The code adds that the building permit fee includes the initial Certificate of Occupancy / Certificate of Compliance, and that the owner is responsible for renewing the Certificate of Occupancy annually, at which time the annual fire inspection is conducted. Per the code's fee table, a change of occupancy classification and a substantial improvement are charged the building permit fee. Contact the Fire Marshal's Office, 469-376-4122. The figures are as printed in the fee tables of the county's adopted fire code, published on the Fire Marshal's Helpful Resources page as "2024 IFC Amendments" and headed "Kaufman County Fire Marshal Permit Fee approved Oct 29, 2024". This applies in unincorporated Kaufman County: the fire code states that it "applies to the unincorporated areas of Kaufman County, Texas". Certificate of Occupancy / Certificate of Compliance (new business or change of ownership)

The Fire Marshal's Certificate of Occupancy page states: "All public buildings, commercial establishments, and residential buildings with four or more units are required to obtain a Certificate of Occupancy from the Fire Marshal's Office before occupying the building." A new certificate is required when a new business will operate in the building or space, or when the ownership of an existing building or business changes. Per the same page, a business that has already applied for a building permit receives its certificate at the final inspection, and the page sets out exceptions for home offices and for home businesses without employees or customers on site. Per the fee table in the county's adopted fire code, a new Certificate of Occupancy / Certificate of Compliance for a new business or change of ownership in the same occupancy class as before is $200, and occupying a building without obtaining a new C.O. adds $100 on top of the new C.O. fee. The page also states that public buildings and commercial establishments must renew the certificate annually: a fire inspector inspects the building, and "Upon passing the inspection, the Certificate of Occupancy will be renewed for a period of one year." Contact the Fire Marshal's Office, 469-376-4122, for the renewal amount. The figures are as printed in the fee tables of the county's adopted fire code, published on the Fire Marshal's Helpful Resources page as "2024 IFC Amendments" and headed "Kaufman County Fire Marshal Permit Fee approved Oct 29, 2024".
