About each permit
Fire Operational Permits — Places of Assembly; High-Piled Storage
Two fire operational permits in unincorporated Kaufman County apply only to some businesses. A restaurant or fitness studio whose premises is classed as a place of assembly under the fire code needs the places of assembly operational permit, and a retail store with high-piled storage of more than 500 square feet needs the high-piled storage operational permit. The Fire Marshal's Operational Permits page states that an operational permit application is required to conduct any operation permitted under the fire code. Per the operational permit table in the county's adopted fire code, places of assembly is $100 and high-piled storage (> 500 sq. ft.) is $100, each with the period "Annual". A business that is not an assembly occupancy and has no high-piled storage is outside these two lines. Ask the Fire Marshal's Office whether the premises is classed as an assembly occupancy. Contact the Fire Marshal's Office, 469-376-4122. The figures are as printed in the fee tables of the county's adopted fire code, published on the Fire Marshal's Helpful Resources page as "2024 IFC Amendments" and headed "Kaufman County Fire Marshal Permit Fee approved Oct 29, 2024". This applies in unincorporated Kaufman County: the fire code states that it "applies to the unincorporated areas of Kaufman County, Texas". A business inside Forney, Terrell, Kaufman, Crandall or another city should contact that city about its own requirements.
Fire Code Building Permit (unincorporated Kaufman County)
A business that builds in unincorporated Kaufman County needs a building permit from the Kaufman County Fire Marshal's Office. The Fire Marshal's Building Permits page states that a building permit application is required to "construct a new building, substantially improve an existing building, or change the use or occupancy type of an existing building", and that "All plans submitted to the Kaufman County Fire Marshal's Office must be stamped by a licensed design professional (architect or engineer)." The page gives the fee formula as gross square footage times the cost per square foot times .003 (0.3%). The Building Permit Fee Schedule in the county's adopted fire code uses the same formula with the ICC Building Valuation Data cost per square foot, and Step 4 states: "The minimum fee for a building permit is $500." The code adds that the building permit fee includes the initial Certificate of Occupancy / Certificate of Compliance, and that the owner is responsible for renewing the Certificate of Occupancy annually, at which time the annual fire inspection is conducted. Per the code's fee table, a change of occupancy classification and a substantial improvement are charged the building permit fee. Certificate of Occupancy / Certificate of Compliance (new business or change of ownership)
A business opening in an existing building in unincorporated Kaufman County needs a Certificate of Occupancy from the Fire Marshal's Office. The Fire Marshal's Certificate of Occupancy page states: "All public buildings, commercial establishments, and residential buildings with four or more units are required to obtain a Certificate of Occupancy from the Fire Marshal's Office before occupying the building." A new certificate is required when a new business will operate in the building or space, or when the ownership of an existing building or business changes. Per the same page, a business that has already applied for a building permit receives its certificate at the final inspection, and the page sets out exceptions for home offices and for home businesses without employees or customers on site. Per the fee table in the county's adopted fire code, a new Certificate of Occupancy / Certificate of Compliance for a new business or change of ownership in the same occupancy class as before is $200, and occupying a building without obtaining a new C.O. adds $100 on top of the new C.O. fee. The page also states that public buildings and commercial establishments must renew the certificate annually: a fire inspector inspects the building, and "Upon passing the inspection, the Certificate of Occupancy will be renewed for a period of one year." Contact the Fire Marshal's Office, 469-376-4122, for the renewal amount. The figures are as printed in the fee tables of the county's adopted fire code, published on the Fire Marshal's Helpful Resources page as "2024 IFC Amendments" and headed "Kaufman County Fire Marshal Permit Fee approved Oct 29, 2024". A day care or child care facility in unincorporated Kaufman County pays an annual Fire & Life Safety Permit fee to the Fire Marshal's Office, set by the number of children it is licensed for. Per the Fire & Life Safety Permit table in the county's adopted fire code, each line has the period "Annual": a facility licensed for 1 to 49 children pays $100, one licensed for 50 to 99 children pays $150, the line printed "Licensed for 99-149 Children" is $200, and a facility licensed for 150 or more children pays $250. The third band is copied as the table prints it; its lower figure overlaps the second band, so a facility at the boundary should ask the Fire Marshal's Office which line applies. State child care licensing by Texas Health and Human Services is separate from this county fire permit. Contact the Fire Marshal's Office, 469-376-4122.
