About each permit

Food Service Establishment Permit

$150 for one to five employees, $200 for six to ten and $250 for eleven or more — the same scale covers a restaurant or on-premises consumption business, a retail food store or grocery, and a warehouse distributor. That makes Midland among the cheapest cities in this dataset for a small kitchen: a five-employee restaurant pays $150 where Frisco would charge $300 and Dallas $773. Two things to watch. The late penalty is unusually harsh — 25% of the permit fee PER DAY past the due date, on top of the fee itself — and there are no refunds on permit fees at all. A permit application must be submitted for each establishment, and an incomplete form will not be processed.

Day Care Facility Health Permit

$100 a year for a day care facility, $50 for a foster care facility and $50 for an after-school child care programme. Midland separates the three where most cities in this dataset have a single childcare band — worth checking which category the operation actually falls into, because the difference is double.

Farmers Market Permit

$50 — half Fort Worth's $100 annual farmers market food vendor permit and half Waco's $100 vendor permit. Note that from 1 July 2026 a mobile unit trading at a farmers market needs a Texas DSHS license regardless of this permit.

Temporary Food Permit

$70 for 14 days or less, and the form names what it covers: fairs, carnivals, circuses and public exhibits. Above the $52 that Arlington, Waco, Pasadena, Frisco and Abilene all charge, and well below Mesquite's $300 temporary annual arts permit. A farmers market permit is $50.

Swimming Pool and Spa Permit

$100 per swimming pool and $100 per spa, each counted separately on the application — so a hotel with a pool and a spa pays $200 a year. Between Mesquite's $150 per body of water and Abilene's $240 flat, and well under Fort Worth's $580 per pool.

Seasonal Food Permit

$105 for a fixed season running 1 April to 30 September — the dates are set by the form, not chosen by the applicant, so a business trading outside that window needs a different permit. Cheaper than an annual food service permit at any employee band, and the right instrument for a summer operation.

Grocery Department Permit

$75 for each deli, bakery, meat market and kiosk a grocery or convenience store operates, with the number of each declared on the application — so a store running a deli and a bakery pays $150 on top of its establishment permit. The application form carries an older sentence saying stores add $25.00 each, which the current fee column supersedes; the $75 figure is the one to use. Verified against the current Environmental Health application by the editorial team.
