County Clerk Wet/Dry Certification for TABC Applicants
Alcohol permits are issued by the state, the Texas Alcoholic Beverage Commission; the county's role is the Hidalgo County Clerk's certification, within 30 days of a request, of whether the location is in an area where the sale is legal and not prohibited by a commissioners court order, under Alcoholic Beverage Code section 11.37. An applicant certified as not wet, or refused, may seek a hearing before the county judge. The county publishes no fee for this certification, so there is no county fee figure to record here. The Clerk is at 100 N. Closner, Edinburg. The certification is by address, so a restaurant, coffee shop, retail store or fitness studio that plans to serve alcohol should request it for its own address rather than rely on county-wide status.
