Business licenses and permits in Hidalgo County, Texas
Hidalgo County, Texas (seat Edinburg) is a limited-powers Texas county with its own Health & Human Services Department. Its Environmental Health Division permits food establishments in unincorporated Hidalgo County, including the extraterritorial jurisdiction, and in municipalities that do not run their own health department; McAllen, Edinburg, Mission, Pharr and Weslaco each run their own health departments, so the county food permit does not apply inside those five cities, and the status of the county's other 17 municipalities is not published. The county Planning Department issues development permits for the unincorporated area only, the county Fire Marshal reviews plans and inspects commercial construction there, and the county is a TCEQ authorized agent for on-site sewage (septic) facilities. The county Clerk issues the wet/dry certification that Texas Alcoholic Beverage Code section 11.37 requires for TABC applicants. The county's 22 incorporated municipalities each run their own business license, building and permit regimes, which stack on top of any county requirement. Mobile food vendors that need a Texas DSHS license from July 1, 2026 fall under state licensing, not a county permit. Childcare operating licensing, veterinary, cosmetology and trade licensing are state functions carried at the state layer.

What do these permits involve in Hidalgo County?
On-Site Sewage Facility (Septic) Authorization
A business on a septic system in unincorporated Hidalgo County needs approval from the county's Environmental Health On-Site Sewage Facilities (OSSF) Division; TCEQ's 2024 authorized-agent report lists Hidalgo County (AR 620100) with 1,333 authorizations to construct. Commissioners Court Order PP.1 makes OSSF approval part of the permit sequence, and a lot under one-half acre without sanitary sewer needs an engineer's design. There is no county septic fee published in any public source, so the record carries no fee figure; contact the county Environmental Health Division at 956-383-0111 for the current amount. TCEQ's same report lists the cities of Donna, McAllen, Mercedes, Mission, Palmhurst and San Juan as separate authorized agents in the county, so a site inside one of them goes to that city.
County Development Permit, Commercial and Industrial (Unincorporated Areas)
A business building, converting, adding to or moving a structure in unincorporated Hidalgo County applies to the county Planning Department, Permitting Division, 2818 S. Business Hwy 281, Edinburg, 956-318-2840. The commercial review package is reviewed jointly by the Fire Marshal, the Health Department and Planning. The fee schedule linked from the county Planning page is labelled 'effective January 1, 2025': commercial $150 up to 1,000 sq ft, $375 up to 2,500, $750 up to 5,000, $1,500 up to 10,000 and $0.15 per sq ft above that; industrial fees start at $50 and scale by valuation; a flood zone area fee is $200 and each re-inspection is $35. The $100 penalty fee applies to construction or added square footage built without a permit but in compliance; it is a flat fee and does not double the permit fee. This permit does not apply inside an incorporated city, where that city's own building department governs.
Fire Marshal Plan Review and Inspection (Unincorporated Areas)
The Hidalgo County Fire Marshal, 2814 S. Business Hwy 281, Edinburg, 956-318-2656, enforces the International Fire Code, reviews plans jointly with the Planning Department for structures in the unincorporated area, and handles fire inspection renewals and plan reviews by appointment. Commercial development permits and utility clearances need Fire Marshal approval as part of the Planning commercial package. There is no fee published for this plan review or inspection: the Fire Marshal page, its forms page and its checklist page state none, and the county publishes no fire fee schedule, so contact the Fire Marshal's office for what applies to a specific project. This applies to the unincorporated area; inside an incorporated city the city's fire department governs.
