Business licenses and permits in Rapid City, South Dakota

Rapid City's own licensing page enumerates the business types the Finance Office licenses — adult oriented business, central station service, ice cream vendor, pawn and secondhand, refuse hauling, security, sidewalk vending, taxi, transportation network and alcohol-related business or event — and then states that 'If you DO NOT have one of these businesses, the Finance Office does not require you to have a business license through their office.' Food is not on that list: RCMC 8.32.020 requires only that a restaurant or grocery store comply with 'all applicable provisions of state law and county health regulations,' so the operative license is the statutory one under SDCL 34-18-11, an annual fee of $90.00 to $225.00 by seating capacity, with Pennington County a second layer. Street vending from a vehicle is prohibited by RCMC 5.48.010 and Chapter 5.48 contains no peddler license, leaving a food truck to operate on private property, at permitted events, or as a sidewalk vendor — a $100.00 annual license under §5.56.050 plus a Sidewalk Vendor Permit at $250.00 with a $100.00 annual renewal. A mobile ice cream vendor license under Chapter 5.50 is a $50.00 nonrefundable fee for a 24-month term with $1,000,000 public liability cover. The Development Application Fee Schedule prices a conditional use permit, a variance, a rezoning, an annexation and a final plat each at $250.00, a planned development designation at $50.00, a sidewalk café at $250.00 and tax increment financing at $2,500.00. Contractor licenses under §15.04.140, building permits and the kennel license under §6.08.050 are all set 'by resolution of the Common Council' rather than in the Code, and Resolution No. 2023-088 (effective January 1, 2024) supplies the amounts: a Class A general contractor license is $200.00 new and $100.00 to renew over three years, with the full trade-by-trade table recorded on the Rapid City contractor license record. Commercial building, gas, plumbing and sign permits are priced from Table 100-C by valuation, from $37.00 at the smallest projects up to $5,608.75 for the first $1,000,000.00 plus $3.15 per additional $1,000.00 above that; commercial plan review is fifty percent of the building permit fee and starting work without a permit doubles it. Electrical contractor and Class B electrician licenses run two years, expiring December 31 of even years with a 60-day grace period. A further fee resolution, No. 2024-106, was adopted at the end of 2024, effective February 1, 2025; it amends only Public Works Department landfill tipping fees, leaving every figure above unchanged. The Finance Office's license list names no salon, fitness studio or auto repair category, and §6.08.050 expressly exempts veterinary hospitals and clinics from the kennel license. Sales tax is 2.00 percent general plus a 1.00 percent municipal gross receipts tax on lodging, eating establishments, alcohol and admissions.

Plan review is 50 percent of the building permit fee for all occupancies except one- and two-family dwellings, which pay 10 percent. Inspections outside normal business hours, re-inspections and inspections for which no fee is specifically listed are each $56.00 per hour (a two-hour minimum for after-hours work, one hour otherwise), and additional plan review required by changes to plans is also $56.00 per hour; outside consultants for plan checking or inspection are billed at actual cost. Commencing work without a permit doubles the permit fee, except for emergency work the Building Official accepts as urgently necessary. A renewed permit is valid for at most 1 year and may be renewed only once without the Building Official’s approval. Air quality permits are published on the same schedule: a compliance plan is $150.00, a construction permit $75.00 for 1 to 5 acres or $100.00 above 5 acres, a permit modification $25.00, a paved parking or storage area permit $75.00 and unpaved $100.00, an amendment $25.00, and an open burn permit no charge.a renewed permit is valid for not more than 1 year and may be renewed only once without the Building Official’s approval2026-09-14

What do these permits involve in Rapid City?

General Business License — City of Rapid City position

The City's Licenses, Permits, Parking & Land Use Applications page lists the business types the Finance Office licenses and then states: 'If you DO NOT have one of these businesses, the Finance Office does not require you to have a business license through their office.' Because that page names no general license, no city fee applies to a business merely for operating in Rapid City. The list is verbatim: 'Adult Oriented Business, Central Station Service, Ice Cream Vendor, Pawn /Precious Metals and Gems/ Second Hand, Refuse Hauling, Security, Sidewalk Vending, Taxi, Transportation Network, or Alcohol Related Business/Event.' Callers outside that list are referred onward — 'Please contact the Department of Revenue at 605-394-2332 if you need help getting a business license other than what is listed under Finance.' Chapter 5.04 supplies the machinery rather than a license: §5.04.010 makes it unlawful to engage in any activity for which a license is required 'without first having obtained a license therefor,' §5.04.040 requires the fee be paid to the Finance Officer before issue and that 'all license fees shall be paid on the basis of a full year,' and §5.04.060 provides that licenses 'shall take effect when issued and shall terminate on December 31 in the year for which issued.' Title 5's chapter list — 5.04, 5.08, 5.12, 5.16, 5.20, 5.24, 5.26, 5.32, 5.36, 5.48, 5.50, 5.52, 5.56, 5.60, 5.64, 5.65, 5.70 and 5.74, with 5.28, 5.40 and 5.44 repealed — names no chapter for food, salons, veterinary practice, fitness or auto repair. The point to keep in mind is that the lack of a general business license is not the lack of regulation: food, childcare and most trades are licensed, just not by the City.

Certificate of Occupancy

No fee for the certificate is published on the City's Building Permits Fee Information page, and §15.04.070 sets none, so none is asserted. The requirement itself is unambiguous and comes straight from the Code: no building may be occupied and no “change in the existing occupancy classification of a building or structure or portion thereof shall be made, until the Building Official has issued a certificate of occupancy therefore.” So a retail unit becoming a restaurant needs a new certificate even if no wall moves. Three further provisions are worth knowing. The Building Official may issue a temporary certificate before the whole permitted work is complete, provided the portion can be occupied safely, and must set a time limit on it. A certificate may be suspended or revoked in writing where it issued in error, on incorrect information, or where the building is found in violation. And issuance “shall not be construed as an approval of a violation” — a certificate is not a defence to one. Because RCMC 8.32.020 sets no city food license, the sequence for a restaurant runs building permit, final inspection, certificate of occupancy, then the state food service establishment license.

Fire Code Inspection and Permits

The fire layer is where a restaurant and an auto repair shop pick up obligations Rapid City's licensing pages do not mention, because the International Fire Code's operational permit list is what triggers them rather than any business license. A commercial kitchen hood suppression system, a spray booth, flammable liquid storage and a place of assembly above the code's occupant threshold each require permits or inspection independently of whether the business needs any license at all. Plan review runs alongside the building permit, so fire review should be started with the building application rather than after it — a suppression system approved late is a common cause of a delayed certificate of occupancy.

Commercial Building Permit

A commercial tenant fit-out is the point at which Rapid City’s otherwise light regulatory touch becomes substantial, and the 50 percent plan review surcharge is the reason: it is five times the rate applied to houses and is the largest single multiplier in the schedule. The contractor doing the work must hold a current Rapid City license before the permit issues, so an unlicensed contractor is a scheduling risk as much as a compliance one, and starting early without the permit doubles the fee rather than merely attracting a penalty. Every figure above comes from Resolution No. 2023-088 (effective January 1, 2024). The table’s shape and every bracket dollar amount are identical to the City's 2016 version of the same table; only the ancillary hourly rate has moved in that time — $47.00 per hour in 2016, $56.00 per hour in the current resolution. Resolution No. 2024-106, effective February 1, 2025, contains only a Public Works Department, Solid Waste Division table raising landfill tipping rates (mixed waste, construction debris, sump grit, asphalt/wood shingles and ash) to a flat $66.00 per ton, and does not touch Table 100-C, contractor licenses or the kennel and pet business licenses. Table 100-C is a Community Development Department schedule; the amendment is a Public Works Department one, and the two do not overlap, so the brackets and rates above remain current through that later resolution.

Conditional Use Permit and Zoning Applications

At $250.00 the conditional use permit is inexpensive relative to what it decides, and for several common small-business uses it is the only city approval carrying real discretion — day care, auto repair and drive-through uses commonly appear as conditional rather than permitted. The schedule’s flatness is its most useful feature: because a variance, a rezoning and a conditional use all cost $250.00, the choice between them turns on which is legally available rather than on price, and getting that choice wrong costs a hearing cycle rather than money. The free items are worth checking before paying for something dearer — a zoning district administrative exception, a planned unit development concept plan and a minor planned development amendment each carry no fee, so the cheapest route to a small dimensional problem may be an administrative exception rather than a variance. The process runs through the Planning Commission with public notice, so the calendar matters more than the fee: a lease signed on the assumption of approval is the main risk.
