Home Occupation Permit

Code §350-510 makes it a violation to operate a home occupation in a residential dwelling, "regardless of zoning district, without first obtaining a home occupation permit", and requires a Chapter 154 business registration as well. The application goes to the Community Development Department on its official form "along with payment of the application fee", and the permit is not effective until the applicant obtains a New Mexico tax identification number and a county business registration approved by Community Development. The section limits the home occupation to 600 square feet (except day-care or child-care services), one non-illuminated sign of one square foot, and no more than two customer or client vehicles at a time (except instructional service, day-care or child-care). Under §350-510, beauticians, hairdressers, barbers and massage therapists licensed by the state are limited to one customer station per residential property; day-care or child-care involving more than six children at the same time requires a special use permit; and health and exercise facilities, motor vehicle repair services and auto or truck repair are prohibited as home occupations except as permitted in the T4 zone per Table 5.1. A home occupation permit need not be renewed unless there is a material change in the activity or its location or a material increase in its size, scope or intensity; the associated business registration is renewed annually with the County Clerk.
