About each permit
Itinerant Vendor's License (food trucks and other mobile vendors)
Code chapter 232 applies to vendors in the county's service area, which excludes "areas within the jurisdictional limits of any incorporated municipality". It defines an itinerant vendor as a person who sells or takes orders for food, merchandise or services "from nonspecified locations, including, but not limited to ice cream trucks, snack wagons, food carts, traveling salesmen and all other mobile vendors." The County Clerk is the issuing agent, but the application first goes to the Community Development Director, whose approval is necessary before the Clerk may issue the license. Code §179-1 sets the itinerant vendor's license at $35 per year, and the county's Vendor's License Application (revised 03/27/24) states that itinerant vendors "shall pay an annual license fee of thirty five dollars ($35.00)." Code §232-8A states: "All food vendors must comply with New Mexico Environment Department Food Service and Food Processing Regulations. An Environment Department, Food Program, food service permit must be obtained prior to approval of a vendor's license." The application asks food vendors to attach a copy of the NMED food facility permit. Under §232-8K every vendor must at all times prominently display the vendor's license issued by the County Clerk's office. Contact the Doña Ana County Clerk's Office, 845 N. Motel Blvd., Room 1-200, Las Cruces, NM 88007, (575) 647-7421.
County Business Registration (annual, per business location)
Code §154-3 imposes "a business registration fee on all persons doing business within the County, but outside the boundaries of any incorporated municipality", and §154-7 charges the fee "on each of his business locations". Code §154-5 states: "Only those businesses which are exempt from a business registration fee by state law are exempt from payment of this business registration fee." The fee schedule in Code §179-1 (amended through Ord. No. 301-2019, February 26, 2019) sets the business registration at "$35/year/business location" and the late fee at "Not more than $10". The County Clerk's Business Registration page states that the applicant must first obtain a New Mexico Tax ID number from the Taxation and Revenue Department, and that "New Business applicants must submit a business registration application to the Planning and Zoning department for approval along with the registration fee of $35.00." Under §154-6A the County Clerk issues the certificate of registration. The page states: "The $35 renewal fee is due by March 16 th. If paid after March 16 th a delinquent penalty of $10 will be incurred." The 2025 renewal form adds that if March 16 falls on a weekend, walk-in renewal fees are due by the prior business day and mail-in renewals must be postmarked by March 16, and that to change ownership or business location the owner files a Cancellation form and a New Business Registration form with a $35 check; the page states "There is no cancellation fee." Under §154-10 the county may prevent the conduct of a delinquent business or the occupancy of its premises. Contact the Doña Ana County Clerk's Office, 845 N. Motel Blvd., Room 1-200, Las Cruces, NM 88007, (575) 647-7421.
Temporary Site-Specific Vendor's License (up to 120 days at one site)
Code chapter 232 defines a temporary site-specific vendor as a person who sells or takes orders for food, merchandise or services "at a specific location for a period not exceeding 120 days." It applies in the unincorporated county only. The license is issued by the County Clerk after the Community Development Director approves the application. Code §179-1 sets the fee at "$5/day; not to exceed $25", and the county's Vendor's License Application states that temporary, site-specific vendors pay "five dollars ($5.00) per day not to exceed twenty five dollars ($25.00) for the entire one hundred twenty (120) day maximum allowable period for each site." The application requires a site plan drawn to scale showing the property boundary, structures, bordering streets, driveways, parking areas and signage, and landowner permission. Code §232-8 sets the site standards: food vendors must hold a New Mexico Environment Department food service permit before the license is approved; each display stand needs at least 20 square feet, a setback of at least 25 feet from any public road or right-of-way and a trash receptacle at least three feet high; two customer parking spaces are required for each display stand plus one for every 200 square feet of display area; and the license must be prominently displayed at all times.
