What does a food truck need in Mecklenburg County Nc that other businesses do not?
1 of the 9 permits particular to a food truck here applies to no other business type we cover in Mecklenburg County Nc: Mobile Food Unit and Pushcart Application and Plan Review.
Food Establishment Permit (annual permit fee)
A restaurant, coffee shop, meat market or other retail food operation, a permitted mobile food unit, and a child care kitchen operating as a food establishment all need this operating permit before opening. Mecklenburg County Public Health describes the programme in its own words: 'The Mecklenburg County Food and Facilities Sanitation Program (F&FS) is a mandated program administered by the local health department pursuant to Chapter 130A of the General Statutes of North Carolina. F&FS issues permits to more than 4,400 food service facilities operating in Mecklenburg County and conducts more than 13,000 facility inspections per year.' The amount is set by the state, not by the county: G.S. 130A-248(d) directs a fee of one hundred twenty dollars ($120.00) for each permit issued, reassessed annually for permits that do not expire, and the NC DHHS Environmental Health Section states that '$70.00 out of every $120.00 collected is distributed to county health departments'. Subsection (d1) adds a $25.00 late payment fee where the fee is not paid within 45 days after billing, and a $150.00 reinstatement fee after a suspension. The permit runs with the establishment rather than the operator: G.S. 130A-248(c) requires a new owner or lessee to apply for a new permit, a change of location requires a new permit under (b), and (b1) expires a permit one year after an establishment closes. Temporary food establishments and limited food services establishments are excluded from this fee by subsection (d) and are covered by the separate $75.00 temporary permit listed elsewhere here. The countywide programme applies inside Charlotte and the six towns alike.
Temporary Food Establishment Permit
A restaurant, coffee shop or food truck vending at a festival, fair or public exhibition in Mecklenburg County needs a temporary food establishment permit for that event. The per-vendor amount is not discretionary: G.S. 130A-248(d2) provides that a local health department 'shall charge each temporary food establishment and each limited food services establishment a fee of seventy-five dollars ($75.00) for each permit issued', and the FY27 Environmental Health Fee Schedule prints the same $75.00. Temporary food establishments are excluded from the $120.00 annual permit fee by G.S. 130A-248(d), so the $75.00 is the whole permit charge for the event. Where an event organiser submits a block of vendor applications, the county charges a separate large-scale organiser fee on a sliding scale printed in the same schedule: $350.00 for 1-5 permits, $700.00 for 6-10, $1,050.00 for 11-15, $1,500.00 for 16-20 and $3,000.00 for 21 or more. Applications are submitted as a package by the event organiser to the county's temporary food events mailbox, TFE@mecknc.gov, rather than vendor by vendor at a counter. A large outdoor event will usually also engage the county special event permit and, outside Charlotte city limits, Fire Marshal permits, both listed separately here.
Mobile Food Unit and Pushcart Application and Plan Review
A food truck or pushcart operating in Mecklenburg County is permitted by Environmental Health. The county defines the categories in its own application packet: a 'Mobile Food Unit' is a food establishment or pushcart designed to be readily moved and vend food, while a 'Pushcart' is restricted to hot dogs and similar pre-cooked encased meats with their condiments, pre-packaged drinks and snacks. The FY27 Environmental Health Fee Schedule prints 'Pushcart/Mobile Food Unit Plan Review 150.00' and 'Mobile Food Unit Change in Commissary 100.00', and the county's own Mobile Food and Pushcart Application Packet states the same two amounts as conditions of application: 'A non-refundable fee of $150.00 will be assessed to the applicant/operator and shall be paid with the submission of the application' and 'A non-refundable fee of $100.00 will be accessed to the applicant for a change/transfer of commissary.' Those are the county-set charges. The recurring operating charge is the statutory one: a permitted mobile food unit is a food establishment and is not within the exclusions in G.S. 130A-248(d), so the $120.00 annual permit fee listed separately here applies to it. Every unit needs a base of operations — G.S. 130A-248(c1) requires a permitted restaurant or commissary to serve as the base for a pushcart, and a mobile food unit must either meet all commissary sanitation requirements or have one. The packet states plainly that the health department 'does not issue verbal approvals regarding construction, design, or permitting of mobile food units and pushcarts', and that a unit not in compliance with 15A NCAC 18A .2600 will not receive an operating permit.
