About each permit
Zoning Commercial Plan Review — unincorporated county, Matthews and Pineville
Mecklenburg County charges zoning commercial plan review on two different tables, and this is the higher of the two. The adopted LUESA Fee Ordinance heads it 'Fees to be charged in the unincorporated County, Towns of Matthews and Pineville based upon the total construction cost of the project', and prices it at $50.00 up to $3,000 of construction cost, $110.00 from $3,001 to $50,000, $420.00 from $50,001 to $100,000, $890.00 from $100,001 to $1,000,000 and $1,050.00 above $1,000,000. Cornelius and Davidson are charged on a separate, lower table listed next here. Mint Hill and Huntersville set their own zoning fees under the same schedule, and Charlotte reviews its own zoning, so a project inside those three municipalities is not charged here at all. The zoning fee is additional to the building permit fee — the building fee schedule carries the reminder 'NOTE: Additional Zoning Fees may apply. See fee schedule.' — and it is assessed on total construction cost rather than on floor area. A restaurant, retail store, salon or clinic fitting out a tenant space in Matthews or Pineville, or building anywhere in the unincorporated county, should budget for this alongside the building, trade and plan review charges.
Zoning Use Permit and Sign Permit
Read the scope before the price. The Zoning Fee Schedule in the adopted LUESA Fee Ordinance is headed 'For jurisdictions requiring zoning review, permitting, and site inspections by Mecklenburg County staff:', and the ordinance then names them: county staff serve the unincorporated county and the Towns of Matthews, Pineville, Cornelius and Davidson. The same schedule states that 'The Towns of Mint Hill and Huntersville provide their own zoning services; therefore, Mint Hill and Huntersville set their own zoning fees', and the City of Charlotte runs its own zoning and appears in no county zoning table — so a business in Charlotte, Mint Hill or Huntersville deals with that municipality for zoning rather than with the county. Where the county does review, § 4.104 of the County Zoning Ordinance puts the Zoning Administrator in the path of building permits, certificates of occupancy, sign permits and zoning use permits alike, and the fee schedule prices a Zoning Use Permit at $160.00, a sign permit at $160.00 up to 100 square feet and $220.00 above that, and a single-family residential permit at $20.00. Any business putting up a fascia sign, a monument sign or a window sign in a county-reviewed jurisdiction needs the sign permit; the zoning use permit attaches to establishing or changing a use. In the unincorporated county, § 4.102(1) of the same ordinance also requires a building permit from the Director of Code Enforcement before construction, reconstruction, demolition, excavation, structural repair, alteration or addition, or paving that will create more than twenty thousand square feet of impervious cover.
Zoning Commercial Plan Review — Cornelius and Davidson
County zoning staff also review commercial projects for the Towns of Cornelius and Davidson, and the adopted LUESA Fee Ordinance charges those two towns on their own, lower table: $30.00 up to $3,000 of total construction cost, $50.00 from $3,001 to $50,000, $210.00 from $50,001 to $100,000, $440.00 from $100,001 to $1,000,000 and $520.00 above $1,000,000 — roughly half the amounts charged in the unincorporated county, Matthews and Pineville. A business opening in Cornelius or Davidson is therefore in the county zoning system but on the cheaper schedule, while one opening in Mint Hill or Huntersville is in those towns' own zoning systems, which the same fee ordinance says they run and price themselves, and one opening in Charlotte is in the City's. The distinction matters at budgeting time and at application time: the zoning review runs in parallel with the countywide Code Enforcement building permit, and it is the town's own zoning ordinance that the county staff apply in these towns, not the County Zoning Ordinance, which § 1.103 confines to the unincorporated area outside any other government's zoning jurisdiction.
Zoning Board of Adjustment Appeal — Variance or Interpretation
Where county zoning staff refuse a use, a setback, a sign or a parking arrangement, the route is an appeal to the Zoning Board of Adjustment, and item 30 of the adopted LUESA Fee Ordinance prices it: a commercial variance is $250.00 each and a commercial interpretation $350.00 each, with the residential equivalents at $100.00 and $150.00. A variance asks the board to permit something the ordinance would otherwise prevent; an interpretation asks it to settle what a provision means for the property in question. The distinction between the two prices is worth reading before filing, because an applicant who needs a ruling on the meaning of a use category pays the higher commercial rate. As with every other county zoning charge here, the fee applies only where county staff perform the zoning function — the unincorporated county, Matthews, Pineville, Cornelius and Davidson. A business inside Charlotte, Mint Hill or Huntersville appeals through that municipality's own board and fee schedule instead. Businesses most often reach this record over a change of use in an existing building, a drive-through or outdoor seating proposal, or signage above the permitted area.
