Business licenses and permits in Stanislaus County, California

Stanislaus County (county seat Modesto; population 556,972, U.S. Census Bureau 2024 estimate) splits business obligations by program. The Treasurer-Tax Collector's three-year 'license to operate' under County Code Chapter 6.04 applies to a business at a fixed place of business 'within the county and outside the limits of any incorporated city', the itinerant vendor permit under Chapter 6.68 applies in 'any unincorporated areas of Stanislaus County', and Title 16 building regulation covers 'all buildings and structures within the unincorporated areas of the county'. The county's Doing Business page lists nine incorporated cities — Ceres, Hughson, Modesto, Newman, Oakdale, Patterson, Riverbank, Turlock and Waterford — and each runs its own business license and building permit regime, which stacks on the county's countywide programs. The Department of Environmental Resources states that it is 'the local enforcement agency responsible for issuing food facility permits, inspecting food facilities, and enforcing the California Retail Food Code within the county', and the Board of Supervisors staff report of 28 April 2026 says Stanislaus County was certified as the Certified Unified Program Agency (CUPA) 'for all of Stanislaus County', with the Department's Hazardous Materials Division administering the program.

What do these permits involve in Stanislaus County?

Business License ('License to Operate', unincorporated area)

County Code §6.04.020 says 'No person shall maintain, conduct, or carry on a business, whether or not for profit, located in whole or in part at a fixed place of business within the county and outside the limits of any incorporated city, without first obtaining a license to operate', and requires a new license for a new or additional location, a change or expansion of the business use of a building, or a change of ownership. The Treasurer-Tax Collector's Fee Schedule (effective July 1, 2024), linked from its Forms page, lists 'Business License application fee (Includes $4 State of California Fee) $146', and the 2026 application tells applicants to take the form to Planning and Community Development for zoning approval first, then return it to the Business Services Division 'with the $146.00 fee'. The Board staff report of 28 April 2026 (PH05) says 'The Treasurer-Tax Collector is not proposing any fee adjustments for business licenses.' Under §6.04.070 the license runs to the end of the month of the original application date in the third license year; the renewal fee and the ten-dollar delinquent penalty are set by Board resolution, and the renewal amount is not published on the fee schedule or the form, so contact the Business Services Division at (209) 525-6549 for it. The application's own instructions say 'If the business is a restaurant or food service related or involves body art, a health certificate from County Environmental Resources in [sic] required', ask contractors for their Contractors' license number and say automotive repair needs a Bureau of Automotive Repair license. The license must be posted in the place of business (§6.04.080).

Building Permit (unincorporated area)

County Code §16.00.010 says Title 16 regulates 'the design, construction, quality of materials, use and occupancy, location, and maintenance of all buildings and structures within the unincorporated areas of the county', so a business building, altering or fitting out premises outside the nine cities takes its building permit from Planning and Community Development's Building Permit Services; work inside a city goes to that city. The Board of Supervisors adopted Ordinance C.S. 1415, amending Building Permit Services fees, on 19 May 2026 (minutes item 6.A.6), and the county's Building Permit Services Fee Schedule is headed 'Effective July 18, 2026'; the schedule prints the adopted amounts in its column headed 'PROPOSED', beside the earlier 'EXISTING' amounts. The valuation-based fee follows the schedule's table, with valuation based on the August 2020 ICC Building Valuation Data. Building Permit Services is at 1010 10th Street, Suite 3400, Modesto, telephone (209) 525-6557.
