Business licenses and permits in Spotsylvania County, Virginia

Spotsylvania County is a Virginia county whose seat, Spotsylvania Courthouse, is an unincorporated community rather than a separate municipal government. Under Virginia's system an independent city is not part of any county, so its ordinances, licenses and fees are its own and are not part of this county listing; an incorporated town, where one exists inside a Virginia county, runs its own town license, zoning and permit regime that stacks on top of the county's. The county's Commissioner of the Revenue administers the Business, Professional and Occupational License (BPOL) tax, which the county's own pages apply only once gross receipts reach $2,000,000 in a calendar year, along with the Business Registration form that every business completes and the 6% county meals tax. The Department of Community Development's Permit Center issues zoning use approvals, home-based business permits, building and sign permits under the county's Fee Schedule (Land Use & Building) Effective July 1, 2026. Food establishment, mobile food unit and temporary event permits come from the Virginia Department of Health's Rappahannock Area Health District, a state agency field office rather than a county department. Alcohol is licensed by the Virginia ABC Authority, a state agency.

What do these permits involve in Spotsylvania County?

Business License (BPOL Tax) — Gross Receipts of $2,000,000 or More

The Commissioner of the Revenue's Business License page states the threshold as "$2,000,000 annually (Effective January 1, 2023)", and the county's Business Brochure (rev 10/1/26) and Business Taxes page carry the same $2,000,000 figure. Per the county's Application & Tax Rate page, a business with gross receipts of $1 to $2,000,000 in a calendar year owes no tax ("A business license is not issued and no tax due"), and at $2,000,000 and above the tax is "Total gross times the tax rate below" — the page states no deduction and no minimum tax. Rates per $100 of gross receipts, as published on that page: Retail Merchants $0.10, Contractors and Out of Area Contractors $0.08, Personal, Business and Repair Services $0.18, Professionals $0.29, Wholesale Merchants $0.025 on gross purchases, Research and Development $0.025, with the remaining classes listed in the fee formula. The Commissioner assigns each business its classification; a veterinary practice falls under Professionals because Code of Virginia § 58.1-3700.1 defines professional services to include services performed by veterinarians. Per the county's Regulations & Dates page, new businesses file as soon as gross receipts pass the threshold, existing businesses renew on or before March 15, payment is due on or before April 15, a 10% penalty applies when filing or payment is late, and interest accrues at 10% per year. The same page requires a business physically located in the county to submit an approved zoning use with the application, and the rate page asks contractors to attach the Virginia Workers' Compensation Form 61A confirmation.

Business Registration Form

The county's Business Brochure (rev 10/1/26) states that "all businesses need to complete a Business Registration form regardless of gross receipts", so a business below the $2,000,000 BPOL threshold still registers with the Commissioner of the Revenue. The current form, "online form - rev 3/2026", covers Business License, Business Tangible Property, Meals Tax, Lodging and Short Term Rental registrations on one sheet and asks for actual and estimated gross receipts. No fee is printed on the form; the official form is the source of that statement, and the Business Tax Division at 540-507-7051 handles questions about it.

Zoning Use Permit — Commercial Use Certificate

The county's Zoning Use page states that "All businesses physically located in Spotsylvania County are required to file a zoning use application with the Community Development Department" and that the approval "must be approved first before opening a business and the issuing of a County business license." For a commercial location this is the Commercial Use Certificate: $120, plus $30 where the property carries proffers, plus the $80 Permit Center Processing Fee, per the county's Fee Schedule (Land Use & Building) Effective July 1, 2026, the adopted county fee schedule currently in effect. A later change of owner or business name at the same use costs $70 under the same schedule. The county's Events & Outreach page links this schedule as the updated Fee Schedule. The schedule notes that applications awaiting issuance are voided after 6 months. This zoning approval applies to every physically located business regardless of the $2,000,000 BPOL threshold.

Commercial Building Permit (New Construction and Alteration)

New commercial construction and commercial alterations are charged by square foot under the county's Fee Schedule (Land Use & Building) Effective July 1, 2026, the adopted county fee schedule currently in effect. The inspection fee is $0.13 per sq. ft. for Group 1 (S, U, H, F and shell buildings), $0.16 for Group 2 (B and M), $0.18 for Group 3 (A-2, A-3, A-4, E, I-4 and R-2), $0.19 for Group 4 (R-1, A-1) and $0.24 for Group 5 (I-1, I-2, I-3), with a $180 minimum. Plan review is charged separately at $0.13, $0.16, $0.17, $0.19 and $0.23 per sq. ft. for the same groups, also with a $180 minimum, and the $80 Permit Center Processing Fee applies. The use group of a given space is assigned by the county's building official under the Virginia Uniform Statewide Building Code. Trade permits, kitchen hoods, spray booths and signs are separate lines recorded in their own records.

Commercial Temporary Certificate of Occupancy

A business that needs to occupy a new or altered commercial space before every final inspection is complete can request a Commercial Temporary Certificate of Occupancy, which costs $105 per the line "Building Commercial Temp. Certificate of Occupancy" in the county's Fee Schedule (Land Use & Building) Effective July 1, 2026, the adopted county fee schedule currently in effect. This is a building-division fee tied to an open commercial building permit, and it applies to any of the industries covered here whose build-out uses that route. It is separate from the zoning use approval every physically located business obtains.

Commercial Sign Permit (Building and Zoning)

A permanent business sign carries both a building fee and a zoning fee under the county's Fee Schedule (Land Use & Building) Effective July 1, 2026, the adopted county fee schedule currently in effect. The building line is $185 for a commercial wall sign and $260 for a freestanding sign, with or without electrical work. The zoning line is $230 plus $110 per sign where the property has no proffers, or $280 plus $110 per sign where it does. A business with more than one sign pays the per-sign zoning amount for each sign on the application.
