About each permit

Zoning Use Permit — Commercial Use Certificate

The county's Zoning Use page states that "All businesses physically located in Spotsylvania County are required to file a zoning use application with the Community Development Department" and that the approval "must be approved first before opening a business and the issuing of a County business license." For a commercial location this is the Commercial Use Certificate: $120, plus $30 where the property carries proffers, plus the $80 Permit Center Processing Fee, per the county's Fee Schedule (Land Use & Building) Effective July 1, 2026, the adopted county fee schedule currently in effect. A later change of owner or business name at the same use costs $70 under the same schedule. The county's Events & Outreach page links this schedule as the updated Fee Schedule. The schedule notes that applications awaiting issuance are voided after 6 months. This zoning approval applies to every physically located business regardless of the $2,000,000 BPOL threshold.

Home Occupation Zoning Permit

The county's Home-based Businesses page describes a home occupation as a low-impact activity such as a home office, artist space, home crafts or internet sales, permitted in all zoning districts in which residential uses are permitted, and states that "Neither employees nor on-site customer/client contact are permitted" (Sec. 23-5.4.2). The fee is Zoning Home Occupations $60 plus the $45 Permit Center Over-the-Counter Permit and Processing fee, both lines in the county's Fee Schedule (Land Use & Building) Effective July 1, 2026, the adopted county fee schedule currently in effect; the Community Development Department's Application Deposits sheet pairs the $60 zoning fee with the $45 processing fee for this permit. A home-based business that needs employees or customer visits uses the home enterprise permit instead. Per the same county page, home daycares with 4 or fewer children "are not considered home-based businesses for the purpose of zoning regulations" and are regulated by the Virginia Department of Social Services.

Home Enterprise Zoning Permit

The county's Home-based Businesses page describes a home enterprise as a low-impact home-based business that allows employees and on-site customer or client access, naming "beauty parlors or other personal service establishments" among its examples (Sec. 23-5.4A.2). That makes it the home-based route for a salon or a small fitness studio. Per the same page, a home enterprise is permitted in residential districts except R-8, R-12, MU-1 and MU-2, where a Special Use Permit is required, and it is not permitted in the R-MHP district. The fee is Zoning Home Enterprise $100 plus the $80 Permit Center Processing Fee, per the county's Fee Schedule (Land Use & Building) Effective July 1, 2026, the adopted county fee schedule currently in effect. A home-based business also remains subject to the county's business license rules, as the county page states.

Temporary Zoning Approval / Temporary Event (Zoning)

When a temporary use or event requires a temporary zoning approval from Community Development, the fee is $225 for the approval and $70 for a renewal, per the line "Temporary Zoning Approvals and Temporary Events" and the "Temporary Zoning Renewal" line in the county's Fee Schedule (Land Use & Building) Effective July 1, 2026, the adopted county fee schedule currently in effect. Whether a particular site, sale or event needs one is a zoning determination made by the county's Zoning office in Community Development (540-507-7222), and the approval can be renewed at the lower renewal fee. This county zoning approval is separate from any health permit a food vendor holds from the Rappahannock Area Health District.

Commercial Building Permit (New Construction and Alteration)

New commercial construction and commercial alterations are charged by square foot under the county's Fee Schedule (Land Use & Building) Effective July 1, 2026, the adopted county fee schedule currently in effect. The inspection fee is $0.13 per sq. ft. for Group 1 (S, U, H, F and shell buildings), $0.16 for Group 2 (B and M), $0.18 for Group 3 (A-2, A-3, A-4, E, I-4 and R-2), $0.19 for Group 4 (R-1, A-1) and $0.24 for Group 5 (I-1, I-2, I-3), with a $180 minimum. Plan review is charged separately at $0.13, $0.16, $0.17, $0.19 and $0.23 per sq. ft. for the same groups, also with a $180 minimum, and the $80 Permit Center Processing Fee applies. The use group of a given space is assigned by the county's building official under the Virginia Uniform Statewide Building Code. Trade permits, kitchen hoods, spray booths and signs are separate lines recorded in their own records.

Commercial Kitchen Hood Permit, Plan Review and Fire Test

A restaurant or coffee shop installing a commercial kitchen hood pays three separate lines under the county's Fee Schedule (Land Use & Building) Effective July 1, 2026, the adopted county fee schedule currently in effect: the building permit for the hood itself ($525 for a Type I grease hood, $435 for a Type II hood), the Range Hood Plan Review ($210 for the first hood and $40 for each additional hood), and the Fire Range Hood Test/Inspection at $175 per hood, which the schedule lists among its fire acceptance-test fees. These charges apply in addition to the commercial building permit for the space when the hood is part of a larger build-out.

Commercial Temporary Certificate of Occupancy

A business that needs to occupy a new or altered commercial space before every final inspection is complete can request a Commercial Temporary Certificate of Occupancy, which costs $105 per the line "Building Commercial Temp. Certificate of Occupancy" in the county's Fee Schedule (Land Use & Building) Effective July 1, 2026, the adopted county fee schedule currently in effect. This is a building-division fee tied to an open commercial building permit, and it applies to any of the industries covered here whose build-out uses that route. It is separate from the zoning use approval every physically located business obtains.

Commercial Sign Permit (Building and Zoning)

A permanent business sign carries both a building fee and a zoning fee under the county's Fee Schedule (Land Use & Building) Effective July 1, 2026, the adopted county fee schedule currently in effect. The building line is $185 for a commercial wall sign and $260 for a freestanding sign, with or without electrical work. The zoning line is $230 plus $110 per sign where the property has no proffers, or $280 plus $110 per sign where it does. A business with more than one sign pays the per-sign zoning amount for each sign on the application.

Spray Booth Permit (Plan Review, Inspection and Fire Acceptance)

An auto-body or auto-repair shop installing a paint spray booth pays $390 for "Spray Booths Plan Review and Inspection", listed among the building division's fire-protection plan review fees, and $175 for the "Fire Spray Booths" line among the fire administrative fees, both per the county's Fee Schedule (Land Use & Building) Effective July 1, 2026, the adopted county fee schedule currently in effect. These charges are in addition to the commercial building permit for the shop itself when the booth is part of a larger build-out.
