What does a food truck need in Summit County Oh that other businesses do not?
1 of the 7 permits particular to a food truck here applies to no other business type we cover in Summit County Oh: Mobile Food Service Operation License.
Mobile Food Service Operation License
A food truck, cart, trailer or other unit that is 'prepared, served or sold from a movable vehicle, portable structure or watercraft, routinely changing location, and does not remain at any one location for more than forty (40) consecutive days' — the definition in SCPH's own Mobile Food Operation Packet, revision 3-6-25 — is licensed as a mobile food service operation by Summit County Public Health. Because SCPH is the combined general health district for the whole county, this applies to a unit based in Akron or Barberton as much as to one in an unincorporated township. The two figures are published in the 2026 APPROVED Environmental Health Fee Schedule at EHC 101.05(e), Exhibit A to SCPH's Environmental Health Code Chapter 101, the adopted schedule for the 2026 calendar year, in effect through 31 December 2026; the $28 in each is the state fee rather than a county charge. The application runs with an overhead drawing of the unit and, where the operation uses one, a commissary agreement signed each year by both the owner and the commissary operator; a pre-license inspection must be passed, and SCPH's packet states that the license fee is paid at that inspection. The late penalty is 25% of the district fee and is assessed only after the first day of operation in a new licensing period. A truck selling goods subject to Ohio sales tax also needs the county vendor's license — ORC 5739.17(C) treats each vehicle as its own place of business — and, where it peddles on streets or public ways in one of the five townships named on the county's Chapter 775 application form, the county peddler license as well.
Transient Vendor's License
This is the license for selling away from a fixed address — fairs, festivals, markets, travelling to the customer — and unlike the county vendor's license it is valid in all eighty-eight counties on one registration. It is issued by the Department of Taxation only, never by a county auditor. Same $50 as the fixed-location license since House Bill 366 took effect on 9 April 2025.
