How much does it actually cost to permit a childcare centre in Elkhart County?

Of the 12 records listed for a childcare centre in Elkhart County, IN, 2 apply to every business of this type and 10 are conditional. Adding every fee on the page together would overstate what most operators pay, because it would include permits they never need.

Day Care (Adult or Child) Zoning Use Approval (Elkhart County Development Ordinance): Filing fees for an Improvement Location Permit or a Special Use Permit are charged by Elkhart County Planning and Development; contact the department for the amount that applies to a given site.

Child Care Centre License: $2 per licensed child capacity for a centre; the statute's fee list names no license fee for a child care home, which pays up to $25 for its annual inspection

Permits for a childcare centre in Elkhart County, IN come from 6 separate offices: Elkhart County Health Department — Environmental Health, Elkhart County Planning and Development — Building Department, Elkhart County Planning and Development — Zoning Administrator, Indiana Secretary of State, Business Services Division, Indiana Department of Revenue, Indiana Family and Social Services Administration, Office of Early Childhood and Out-of-School Learning. No single office issues them all, which is why an opening means filing in several places rather than one.

What does a childcare centre need in Elkhart County that other businesses do not?

2 of the 2 permits particular to a childcare centre here apply to no other business type we cover in Elkhart County: Day Care (Adult or Child) Zoning Use Approval (Elkhart County Development Ordinance) and Child Care Centre License.

Day Care (Adult or Child) Zoning Use Approval (Elkhart County Development Ordinance)

The Elkhart County Development Ordinance, section 158.05(B)(4)(f), defines Day Care, Adult or Child as "A business that provides licensed care in a protective setting for children or elderly or disabled adults for less than 24 hours per day", including Class II child care homes as defined by IC 12-7-2 and excluding licensed Class I child care homes, "which are permitted in all districts with residential uses". The ordinance's use tables mark the use as a Special Use (S) in the R-3, R-4, M-1 and M-2 districts, as a Permitted Use (P) in the B-1, B-2 and B-3 districts, and as Permitted Subject to Conditions (C) in the E-3 district, where a child care center must be enclosed within the larger office building except for outdoor play areas; districts left blank in the table prohibit the use. A child care centre or Class II home in the area the ordinance covers (the county outside the planning jurisdictions of Goshen, Elkhart and Nappanee) therefore needs the zoning approval its district requires, plus the Improvement Location Permit of section 158.11(L) for a new or changed nonresidential use. Contact Elkhart County Planning and Development for filing fees and the hearing schedule.

Child Care Centre License

A centre's fee is a formula rather than a number — two dollars per licensed child capacity, so a sixty-child centre pays $120. Indiana Code section 12-17.2-2-2 lists every processing fee the division may charge, and that list names no license fee for a child care home: a home's only listed charges are an application packet of up to $5 and an annual inspection fee of up to $25. Under sections 12-17.2-4-12 and 12-17.2-5-12 a centre's license lasts three years and a home's two. A registered child care ministry pays $100 in all — $50 to the division and $50 to the state fire marshal, each for processing its registration. The statute says the division may charge the centre fee rather than must, so ask the division what it currently collects when applying.

The other 5 local permits in the tables apply to every type of business in Elkhart County, IN; what each one involves is set out on the Elkhart County permits page. The 5 state-level registrations apply to every type of business across IN and are covered on the IN state page.
