How much does it actually cost to permit a restaurant in Kauai County?

There is no single figure, and any site quoting one is rounding away the part that matters. Of the 23 records listed for a restaurant in Kauai County, HI, 7 apply to every business of this type and 16 are conditional. Adding every fee on the page together would overstate what most operators pay, because it would include permits they never need.

Of the 7 that always apply, 2 carry a flat fee, coming to $20.00. That is a floor, not a total. 10 of the 23 are charged as a range or a formula set by the issuing agency, and 4 have no fee published at all. The ones particular to this business that vary:

Liquor License (Restaurant or Retail Dealer): Annual basic fee by class and kind under Liquor Control Commission Rule 4.1: Restaurant (Class 2) — General $480, Beer & Wine $180, Beer $120; Retail Dealer (Class 4) — General $480, Beer & Wine $180. Both classes also pay an annual percentage fee on final gross liquor sales under Rule 4.4, set each fiscal year by the Commission's formula. A new or transferred license carries a $100 filing fee (Rule 2.8) and a deposit for the cost of publishing the public-hearing notice (Rule 2.7).

Food Establishment Permit: $300–$400 a year for a restaurant, banded by risk category and floor area

The other 8 variable fees belong to permits that apply to every type of business here; their formulas are set out on the Kauai County permits page and the HI state page.

What does a restaurant need in Kauai County that other businesses do not?

Liquor License (Restaurant or Retail Dealer)

Required of any restaurant, coffee shop or retail store on Kaua'i that sells alcohol — the one County license that reaches the food and retail industries covered here. Liquor licensing in Hawaii is run by each county's liquor commission under Chapter 281 of the Hawaii Revised Statutes; on Kaua'i the Department of Liquor Control investigates applications for the Liquor Control Commission. The Commission's rules, whose current edition took effect on October 20, 2025, set the annual basic fees in Rule 4.1: a Restaurant (Class 2) license costs $480 for General, $180 for Beer & Wine and $120 for Beer, and a Retail Dealer (Class 4) license costs $480 for General and $180 for Beer & Wine. Both classes also pay a percentage fee under Rule 4.4, calculated from each licensee's final gross liquor sales by a formula the Commission sets each fiscal year; the gross sales report is due by July 31 and the percentage fee on October 31. A new license or a transfer carries a $100 filing fee under Rule 2.8, and every application must be accompanied by a deposit to cover publishing the notice of its public hearing (Rule 2.7). Every license expires at midnight on June 30; renewals are filed from June 1 to June 30 with a current state tax clearance and proof of $1,000,000 in liquor liability insurance (Rule 2.6). A license not exercised within 180 days of the Commission's approval becomes void, except for good cause (Rule 5.1). A temporary license of any class costs $60 for an initial period of up to 120 days. Contact the Department of Liquor Control at (808) 241-4966 or liquor@kauai.gov.

Fire Permit — Places of Assembly

Required only for a place of assembly with an occupant load of three hundred or more people. Ordinance No. 1167 (Bill No. 2938), which adopted the 2021 State Fire Code for Kaua'i with local amendments, states: 'The operation of a place of assembly requires an annual permit. The annual permit fee is $50.00.' Its amendment to Section 20.1.1.1 sets the threshold: 'A permit is required for places of assembly with an occupant load capacity of three hundred (300) or more persons, such as restaurants, nightclubs, dancing, and drinking establishments.' The ordinance took effect sixty days after the Mayor approved it in January 2025. The same fee section prices tents and canopies at $30.00 and the application of flammable finishes at $50.00 a year. A restaurant, gym or store with an occupant load below three hundred does not need this permit. Apply through the Prevention Bureau at (808) 241-4985 or kfdpreventionbureau@kauai.gov.
