About each permit

Retail Food Service / Retail Food Market Establishment Permit (Allen County Department of Health)

Allen County Code 10-2-2-1 makes it unlawful to operate a food establishment "in Allen County, Indiana" without a valid permit from the Health Commissioner for each operation, so a restaurant, coffee shop or food market needs this permit whether it is in Fort Wayne, another city or town, or the unincorporated county. As set in Allen County Code Title 10, Article 14 (Fees), Ord. No. 02-24-23-10 of February 24, 2023, effective April 1, 2023, the annual permit for a retail food service establishment is priced by staff size ($300 for 1 to 5 employees up to $500 for 41 or more) and for a retail food market by floor area ($300 under 3,000 square feet up to $1,125 above 60,000), with $150 a year for a business that sells only dispensed beverages or pre-packaged non-potentially-hazardous food. A new establishment also pays a $280 plan review, application and inspection fee, a new owner $175, and a construction or remodel review $150; these are charged on top of the permit. Under 10-14-3-1-3 the annual fee becomes 125% when a business opens before getting its permit or renews after the anniversary date. Under 10-2-2-7(A) of the Food and Beverage Ordinance (Ord. No. 03-14-25-02, effective July 1, 2025) the permit runs one year from issue and is renewed by the 15th of the anniversary month. The department's Retail Food Establishments page states that "Operators should submit plans to the Department prior to obtaining any permits from the Allen County Building Department", and warns that skipping this can bring a stop work order and fines. Mobile Food Service / Mobile Food Market Establishment Permit (Allen County Department of Health)

A food truck or other mobile food service or mobile food market unit operating anywhere in Allen County, Indiana needs a permit from the Health Commissioner under Allen County Code 10-2-2-1, and under 10-2-2-7(A) the permit lasts one year from issue and is renewed by the 15th of the anniversary month. A new unit pays the $280 New Establishment Plan Review, Application and Inspection Fee set in Allen County Code Title 10, Article 14 (Fees), Ord. No. 02-24-23-10 of February 24, 2023, effective April 1, 2023 (10-14-3-1-1(A)); the department's Annual Mobile Food Unit packet lists the same $280. That fee is in addition to the annual mobile permit fee; contact the Department of Health at (260) 449-7561 for the current annual amount. Where the county's zoning applies, Allen County Zoning Ordinance 3-4-3-4(a) makes a mobile food service unit a permitted use in the C2, NC, SC, C3, C4, I1, I2 and I3 districts and an accessory use to an institutional building in any district, on a site up to five times in twelve months for up to five days per event, with no limit in a public park during a festival or in a public right-of-way, and states that "No Improvement Location Permit or Certificate of Compliance shall be required." Under 3-4-3-4(b) a unit staying beyond those limits, for up to four months in twelve, needs an Improvement Location Permit or Site Plan Review. A unit inside a city or town follows that municipality's rules as well.

Temporary Food Service / Temporary Food Market Establishment Permit (Allen County Department of Health)

Selling or giving away food at a fair, festival or other short event in Allen County, Indiana calls for a temporary food service or temporary food market permit from the Allen County Department of Health. Under Allen County Code 10-2-2-7(B) the permit lasts no more than 14 consecutive days. As set in Allen County Code Title 10, Article 14 (Fees), Ord. No. 02-24-23-10 of February 24, 2023, effective April 1, 2023 (10-14-3-1-2(E)), the fee is $50 for every 48 consecutive hours of operation, and the department's Temporary Food Service application (Rev. 11-12-24) prices the same steps from $50 for one or two days to $350 for 13 or 14 days. Under 10-2-4-4(A) of the Food and Beverage Ordinance, a permittee who does not obtain the permit 24 business hours before the scheduled operation is charged a $50 penalty on top of the permit fee for the first violation, and each later violation adds a further $25; under 10-2-4-4(B) a $25 penalty applies to a permittee who does not arrive within one hour of its self-designated operating time, and no further permits are issued until penalties are paid. Department of Health: (260) 449-7561.

Public and Semi-Public Swimming Pool and Spa Permit (Allen County Department of Health)

Allen County Code 10-5-2-2 states that "It shall be unlawful for any person to operate a public or semi-public pool in Allen County, Indiana, who does not possess a valid permit from the Health Commissioner", and the ordinance's definition of a semi-public pool names health clubs; the Department of Health's Public Pools & Spas page lists fitness centers among the facilities it permits and inspects. A fitness studio with a pool or spa therefore needs this permit, one for each pool structure (10-5-2-3), posted in a conspicuous place; a studio without a pool or spa has no pool permit. As set in Allen County Code Title 10, Article 14 (Fees), Ord. No. 02-24-23-10 of February 24, 2023, effective April 1, 2023, a pool or spa open only from May through September pays a $300 seasonal fee ($100 for each additional one with the same owner at the same location), and one operating in other months pays $525 a year ($150 for each additional one). Opening before obtaining the permit or renewing late raises the fee to 125%. The permit runs one year or less and is renewed on or before the anniversary date. The department's page says year-round pools get a full inspection at least twice a year and seasonal pools at least once.

Commercial On-Site Sewage System Construction Permit (Allen County Department of Health)

A business site in Allen County that is not on a public sewer and installs, replaces, alters or repairs an on-site sewage system goes through the Allen County Department of Health; the department's Septic Systems page says its Environmental Services Division issues permits and conducts inspections for all new on-site sewage disposal systems and repairs to existing systems in Allen County. The department's commercial construction permit application states it is to be used "for all installations except for a 1 and 2 family residence." Under 410 IAC 6-10.1-50, a commercial on-site sewage system needs a state construction permit before the local permit. As set in Allen County Code Title 10, Article 14 (Fees), Ord. No. 02-24-23-10 of February 24, 2023, effective April 1, 2023 (10-14-3-2-1), the county construction permit costs $300 for a new or replacement system, $175 for an alteration, repair or sanitary vault privy and $100 for an existing component, with $80 for abandonment and $45 to revise a permit before construction; the department's 2026 New System permit packet lists the same $300, $175 and $100 for commercial systems. Where the application calls for it, the Allen County On-Site Wastewater Management District then issues an operation permit, priced under 10-14-3-8-1 at $150 every three years for a gravity system, $150 every two years for a mechanical system, $100 a year for pre-treatment and $150 a year for a discharging system. A site on a public sewer has no septic permit.
