Business licenses and permits in Hamilton County, Indiana

Hamilton County, Indiana, seat Noblesville; population 379,704 (U.S. Census Bureau 2024 estimate). The Hamilton County Health Department permits food service and food store establishments, mobile and temporary food operations, public and semi-public pools and spas, body art establishments and artists, and on-site sewage systems and private wells, with fees set in County Code 16-20-1-27; its food code applies to establishments in Hamilton County, inside the cities and towns as well. Planning works differently: the county's Zoning Jurisdictions page describes nine planning jurisdictional areas, those of the Hamilton County Plan Commission, the Cities of Carmel, Fishers, Noblesville and Westfield, and the Towns of Arcadia, Atlanta, Cicero and Sheridan. The Plan Commission issues building, commercial, sign, electrical and home-occupation permits and certificates of occupancy only in its own jurisdictional area, shown on the county map in White River, Wayne and Noblesville Townships, under the Hamilton County Unified Development Ordinance. Each city and town administers planning and permits in its own area and may add its own licenses, which stack on the county and state records; the Health Department's mobile food application, for example, tells operators to contact the city or town where they will operate about an additional mobile permit. The County Surveyor certifies business locations for alcoholic beverage permit applicants, and the Highway Department permits commercial driveways onto county roads.

What do these permits involve in Hamilton County?

On-Site Sewage System (Septic) Permit and Installer Registration (Hamilton County Health Department)

Hamilton County Code 16-20-2-4(a) applies "to any residential or commercial on-site sewage system constructed in the county", under Indiana Department of Health rules 410 IAC 6-8.3 and the commercial on-site sewage rule 410 IAC 6-10. Under 16-20-2-4(d) no person may construct, install, alter or repair an on-site sewage system without first filing a written application and obtaining a written permit, so a business site not on a public sewer that builds or repairs a septic system needs one; a site on public sewer has no septic permit. Under 16-20-2-4(b) every person who constructs, installs, alters or repairs on-site sewage systems in the county must be on the Health Department's contractor registry, for a term from January 1 to December 31, registered before applying for a permit and renewed annually. As set in Hamilton County Code 16-20-1-27, Health department fees (Ord. 10-14-24-B, 10-14-2024, effective January 1, 2025; Ord. 06-09-2025-A, 6-9-2025), as codified on Municode, Schedule D, septic construction costs $250; a septic tank or perimeter drain only $100; a permanent holding tank $100 and its annual renewal permit $100; a re-inspection $75; and installer registration $25. Under 16-20-2-4(c) a failing commercial system must connect to sanitary sewer when sewer is available within 300 feet at a cost within the code's limit.

Private Well Construction and Pump Permits (Hamilton County Health Department)

Under Hamilton County Code 25-39-4-1(b)(1), before construction of a well or geothermal heat pump system begins, the owner or agent must obtain a written permit signed by the county health officer, and no work may be done until the permit is obtained; under (b)(2) the same applies before installing a pump or other facilities that convey water from a well. A business on a private well, and a contractor drilling or fitting one, therefore deals with the Hamilton County Health Department. A site without a private well has no well permit. Permits are valid for one year after the date of issue, and in an emergency the applicant notifies the health officer and obtains a permit within the next scheduled workday. The permit inspection fee is the amount set in 16-20-1-27: as set in Hamilton County Code 16-20-1-27, Health department fees (Ord. 10-14-24-B, 10-14-2024, effective January 1, 2025; Ord. 06-09-2025-A, 6-9-2025), as codified on Municode, Schedule F, a well construction permit costs $125 and a well pump replacement $50, paid to the county Health Department when the permit is issued.

Commercial Building Permit, Improvement Location Permit and Certificate of Occupancy (Hamilton County Plan Commission)

This record applies only in the Plan Commission's jurisdictional area (shown on the county map in White River, Wayne and Noblesville Townships). The Plan Commission page says the Commission "has jurisdiction over the areas of the County shown in blue on the map", and the county's Zoning Jurisdictions page lists nine planning jurisdictions, so a site in Carmel, Fishers, Noblesville, Westfield, Arcadia, Atlanta, Cicero or Sheridan follows that municipality's process instead. Within that area the Plan Commission's FAQ says all structural improvement, repair or addition needs a building permit, other than replacing windows and doors, interior decorating, exterior painting and re-shingling. As set in Ord. 09-12-2022-A, the Hamilton County Plan Commission's Schedule of Fees (Exhibit A), certified by the Plan Commission on 17 August 2022 and adopted by the County Commissioners on 12 September 2022, a commercial primary structure costs $350 plus $0.15 per square foot plus a $125 certificate of occupancy; commercial accessory structures and additions $250 plus $0.15 per square foot plus $125; commercial remodels $200 plus $0.15 per square foot plus $125; a commercial parking lot $125; a change of use $100; an improvement location permit $200 plus $5 per acre; electrical (other) $175; a commercial inspection $150 and a re-inspection $175. The county's Fee Schedule page, which links this 2022 schedule, states that work begun before a permit costs 1.5 times the regular fee for a first offence, 2 times for a second and 3 times for a third. Occupying a building before its certificate of occupancy costs $1,200, and $2,400 for each additional occurrence by the same company. The ordinance took effect ninety days after notice of its adoption was published.

Sign Permit (Hamilton County Plan Commission)

A business putting up a sign in the Plan Commission's jurisdictional area (shown on the county map in White River, Wayne and Noblesville Townships) applies to the Hamilton County Plan Commission, whose page lists a Sign Permit application among its forms; a sign inside one of the cities or towns goes through that municipality. As set in Ord. 09-12-2022-A, the Hamilton County Plan Commission's Schedule of Fees (Exhibit A), certified by the Plan Commission on 17 August 2022 and adopted by the County Commissioners on 12 September 2022, a commercial ground, wall or canopy sign costs $150, a commercial window sign $75 and a home occupation sign $25. For temporary signs the schedule charges nothing for a sign displayed under 30 days, $50 for temporary uses and $25 for a grand opening or closing. The Fee Schedule page states that work begun before a required permit costs 1.5 to 3 times the regular fee, rising with each offence. The Planning Department is at 9615 E 148th Street, Suite 101, Noblesville; 317-776-8490.

Commercial Driveway Permit on a County Road (Hamilton County Highway Department)

This record covers a commercial driveway connecting to a county highway. Hamilton County Code 8-17-4-2 requires anyone who wants to do construction or other work within the county's right-of-way to apply for and receive approval before construction starts, on Highway Department application forms. County Code 8-17-4-1 defines a commercial drive as one serving a property zoned commercial or a place of business; a minor commercial drive has only tapers, and a major one has auxiliary lanes. As set in County Code 8-17-4-2(e) (Ord. 12-10-12-A of December 19, 2012, effective January 1, 2013), a minor commercial driveway costs $400 per drive and a major commercial driveway $400 per drive plus $1.00 per square foot of full-width auxiliary lane pavement. The fee is paid by check or money order to the "Hamilton County Treasurer" with the application, and no permit is reviewed until it is received. A permit bond naming the Board of Hamilton County Commissioners is also required; 8-17-1-3 sets minimums of $10,000 per minor and $25,000 per major commercial drive. The permit expires one year from application or 60 days before the bond expires, whichever comes first.
