What does a restaurant need in Hamilton County Oh that other businesses do not?
Temporary Food Service Operation / Temporary Food Establishment License
A stall, cart or truck selling food at a Hamilton County festival, market or fair takes a temporary license from Hamilton County Public Health for that event, at $68.00 — a figure that appears twice, on the Environmental Health fee table and on page 1 of the county's own 2026 Temporary Food License Application packet. HCPH's food service licensing page defines the scope in its own words: 'Temporary food service operation licenses are required for any person/group who wishes to prepare and sell food for 5 consecutive days or fewer in the same location', and it sets a hard lead time — apply at least ten days before the event. Two limits shape how often this route can be used. ORC 3717.43(E)(1) permits a licensor to issue 'not more than ten temporary food service operation licenses per licensing period to the same person or government entity to operate at different events', and only one license for each particular event, and ORC 3717.43(D) makes a temporary license non-renewable, so an operator trading regularly is looking at a mobile or fixed license instead. One exemption is worth knowing because it comes up constantly at community events: HCPH states that 'Churches are not required to apply for a temporary license if the food will be sold on church property and all proceeds will go back to the church.' The county's application packet still prints the former William Howard Taft Road address; HCPH's current office is 1701 Patricia McCollum Way, Dept. 93, 5th floor, Cincinnati OH 45237.
Small Flow On-Site Sewage Treatment System (SFOSTS) Permit to Install
This record only reaches a business whose premises is on an on-site system rather than on Metropolitan Sewer District sewer, which in Hamilton County means the outer townships and the pockets MSD does not serve — the county's own development-process page names Glendale, Indian Hill, Terrace Park, Harrison, Harrison Township and Whitewater Township among the exceptions to MSD service. Where that is the case, a commercial building is a small flow on-site sewage treatment system in the county's terms, and the permit to install it is $800.00 under the Division of Water Quality's STS Program fee schedule, headed 'Effective 12/1/2023 Regulation 5-2023'; $74 of that total is a state fee the county collects. The lifetime cost is larger than the install permit alone: altering a SFOSTS costs $300.00, $400.00 or $500.00 by job cost band, abandoning any system is $150.00, the operation permit is $80.00 for a year or 58 months, and operation inspections run $150.00 for the initial and first re-inspection and $200.00 thereafter. Household systems are priced separately and lower on the same sheet ($700.00 to install an HSTS or a type 2 to 4 GWRS), so a commercial applicant should not read the household row. The schedule also carries a penalty clause worth planning around, stated in its closing paragraph: 25 per cent of the local fee is charged under ORC 3709.09 'when work is performed prior to obtaining application/permit or when an inspection fee or operation permit fee is not submitted within 60 days of being due'. A restaurant, salon, childcare centre or veterinary clinic on septic should treat this permit as sitting on the critical path with the building permit, because the system sizing depends on the fixture count and the projected flow.
Minor Subdivision (lot split) — final submission
This record reaches a business only when land is being divided or platted rather than simply built on — splitting a parcel to sell off a pad site, carving a lot for a second building, or platting for a new commercial development. The county's development-process page states that 'All subdivision functions within the unincorporated townships in Hamilton County are coordinated through the Hamilton County Subdivision Administrator in the Planning and Development Department', working to the Regional Planning Commission's Rules and Regulations for Plats and Subdivision of Land within the Unincorporated Territory of Hamilton County. Appendix C-1 of those regulations, effective 1 January 2026, prices a minor subdivision (a lot split) final submission at $255.00 per lot plus the 5 per cent technology fee that has applied to these schedules since 17 January 2017. A larger project is priced quite differently: a major subdivision of more than five lots pays a $2,178 base fee for 6 to 20 lots plus $109.00 for each lot above 20, capped at $16,023.00, and the improvement plan and record plat are each $1,283.00 unless already paid at the preliminary plan stage. A subdivision variance is $450.00. Because the platting step produces the lots that everything else attaches to, it runs ahead of the zoning certificate and the building permit, and the stormwater submittal explicitly covers inspections for one year after the record plat is recorded.
Liquor Permit — County Notice and Objection Hearing (unincorporated premises)
Every liquor permit in Ohio is issued by the Division of Liquor Control in the Department of Commerce, and ORC 4303.26(A) gives the county a procedural role rather than a licensing one — but for a premises outside municipal limits it is a real step that can add two months to an opening. The statute provides that on an application for a new class C or D permit, or a transfer of ownership or location, no permit shall be issued 'until the division notifies the legislative authority of the municipal corporation if the business or event is or is to be located within the corporate limits of a municipal corporation, or the clerk of the board of county commissioners and the fiscal officer of the board of township trustees in the county in which the business or event is or is to be conducted if the business is or is to be located outside the corporate limits of a municipal corporation, and an opportunity is provided officials or employees of the municipal corporation or county and township... for a complete hearing upon the advisability of the issuance, transfer of ownership, or transfer of location of the permit.' So a restaurant in an unincorporated township deals with the Board of County Commissioners and the township trustees, while one inside a city or village deals with that municipality's legislative authority. The hearing must be requested within thirty days of the notification, extendable by thirty more for cause, and an objection may not rest on local zoning regulations prohibiting alcohol sales in an area zoned commercial or industrial. A separate 500-foot rule applies to any regular permit except F-2: where the premises is within 500 feet of a parcel containing a school, church, library, public playground or township park, those authorities are served with written notice and given the chance to be heard, and on written request the hearing is held in the county seat. The county charges no fee for the notice or the hearing; the $100 application processing fee that ORC 4303.26(A) mentions is payable to the Division of Liquor Control with the permit application, and the annual permit fee for each class is a state charge set in ORC Chapter 4303.
Food Service Operation License
There is no single Ohio restaurant license fee. The state's share is fixed by rule at $28 for a commercial food service operation of any size or risk level, $14 non-commercial and $6 per vending machine location; the rest is set by whichever of roughly a hundred and ten local boards of health licenses your address. Under rule 3701-21-02 the license is issued by the local board of health; the Department of Health approves those boards and binds them to a uniform method, so every district's schedule has the same shape: four risk levels by two floor-area bands, commercial or non-commercial, with non-commercial fixed at exactly half of commercial. Each district must run an annual cost analysis and hold a public hearing before changing its figure. Renewal is due by 1 March and a late application costs a further 25 per cent. Only the vending machine fee is capped against inflation; restaurant and mobile fees are not.
