How much does it actually cost to permit a restaurant in Douglas County Ne?

There is no single figure, and any site quoting one is rounding away the part that matters. Of the 16 records listed for a restaurant in Douglas County Ne, NE, 3 apply to every business of this type and 13 are conditional. Adding every fee on the page together would overstate what most operators pay, because it would include permits they never need.

Food Establishment Permit (Douglas County Health Department): Annual DCHD permit fee by permit type (Food & Drink, Drink Only, Caterer, Commissary, Retail Food, Separate Facility), plus a DCHD initial permit fee for a new establishment and the Nebraska Department of Agriculture's one-time state ID fee (a state fee). Contact DCHD for the current amount.

Retail Liquor License, County Board role (premises outside city and village limits): Annual retail license fee set by state statute (Neb. Rev. Stat. 53-124.01) and paid to the Douglas County Treasurer for premises outside city/village limits (53-124(6)(b), (9)): Class A $100; Class B $100; Class C $300; Class D $200; Class I $250; Class J $50; bottle club $300. State fees paid to the Nebraska Liquor Control Commission: $400 non-refundable application fee for a new license and $45 renewal fee (53-131). Applicants also bear the costs of the County Board's Resolution 2006-375 notification policy.

Special Designated Liquor License, Douglas County local recommendation (events outside city and village limits): The Clerk's Liquor and Tobacco Licenses page publishes no county fee for the local recommendation. Food Establishment Permit (Douglas County Health Department)

DCHD's "Do I Need A Food Permit?" page states: "All Food Establishments must apply", defining a food establishment as "An operation that stores, prepares, packages, serves, vends, or otherwise provides food for human consumption." It states that food permits are non-transferable, that a change of ownership requires a new permit, and that establishments must comply with the current Nebraska Food Code before receiving a new permit; inspectors are assigned by DCHD's county territory map. The page lists as exempt from a DCHD permit cottage food vendors, whole produce stands (which may also sell pre-packaged non-TCS food from a licensed manufacturer), and bottle clubs that only open or sell non-TCS pre-packaged drinks (a permit is needed if they wash dishes, prepare mixed drinks or use ice); warehouses, distributors, co-packers and manufacturers apply to the Nebraska Department of Agriculture (NDA). DCHD's Permit Types page lists the permit types (Food & Drink, Drink Only, Caterer, Commissary, Retail Food by number of checkouts, Separate Facility) and states that the inspector makes the final determination of the type. DCHD's Permit Types page is headed "PERMIT TYPES FOR 2025", and the Douglas County Board of Health minutes of September 17, 2025 (item F) record approval of a "Resolution for Douglas County Health Department regarding 2026 Environmental Health Fee increases"; the text of that resolution is not published on DCHD's site. DCHD's pages state that every new establishment also pays a one-time permit fee to the NDA for a state ID, which DCHD may collect and forward. Neb. Rev. Stat. 81-2,281(2) lets the NDA contract with a political subdivision for regulatory functions other than the issuance, suspension or revocation of permits, and exempts permit holders inspected under such a contract from the state inspection fees "if such holders pay license or inspection fees to the political subdivision performing the inspections"; the Board of Health's August 19, 2026 agenda lists an agreement with the NDA for a cooperative program of inspection and regulation of food establishments. Contact the Douglas County Health Department, 1111 S. 41st St., Suite 130, Omaha, NE 68105.

Retail Tobacco and ENDS License (establishments outside city, town and village limits)

The County Clerk's Liquor and Tobacco Licenses page states that the office issues tobacco licenses "to establishments that are outside the limits of any city in Douglas County" and points applicants to the county GIS map to check whether a site is inside city limits. Under Neb. Rev. Stat. 28-1421 and 28-1422 a license to sell cigarettes, cigars, tobacco or electronic nicotine delivery systems at retail is applied for with the county clerk where the place of business is outside the limits of any city, town or village; the written application must state, among other things, an email address for contacting the applicant (28-1422(1)), and the clerk notifies the Tax Commissioner and transmits the application materials (28-1422(4)). The fee is set by state statute: 28-1423 fixes it at $10 for locations outside cities, towns and villages, halved if the application is made after July 1, and the license runs to December 31, so it is renewed each calendar year. The Clerk's page asks applicants to return the completed, signed and dated application with the $10.00 fee to 1819 Farnam, H08, Omaha, NE 68183; the Clerk/Comptroller signs the license, the county seal is affixed, and the license is sent by certified mail. A store inside a city, town or village applies to that municipality under the same statute. Contact the Douglas County Clerk/Comptroller, Omaha-Douglas Civic Center, 1819 Farnam Street, H08 (Harney St level), Omaha, NE 68183.

Retail Liquor License, County Board role (premises outside city and village limits)

Nebraska retail liquor licenses are issued by the Nebraska Liquor Control Commission, and for premises outside the corporate limits of any city or village the Douglas County Board of Commissioners is the local governing body. The Clerk's Liquor and Tobacco Licenses page sets out the steps: the applicant obtains and returns the application to the Commission, the Commission forwards it to the Clerk, and the Clerk asks the Board to set a public hearing and notifies the applicant in writing of the date. Under 53-131(2) the Commission notifies the county clerk, and the Board has 45 days to make its recommendation; under 53-134 the Board holds the hearing and records a resolution recommending issuance or refusal, and receives license fees for payment to the treasurer. Under the Board's Resolution 2006-375, as set out on the Clerk's page, an applicant for a new location, a transfer to a new location, an addition to premises or an upgrade of retail privileges submits a list of all property owners within 500 feet prepared and certified by a registered abstractor, notifies each of them in writing at least 10 business days before the hearing, files a notarized affidavit of that notice before the hearing, posts a notice on the premises at least 10 business days before the hearing, and bears all costs. The annual class fee is set by state statute, not by the county: 53-124.01 sets Class A $100, Class B $100, Class C $300, Class D $200, Class I $250, Class J $50 and a bottle club license $300, and 53-124(6)(b) and (9) require it to be paid to the county treasurer for premises outside city/village limits. The Commission's own $400 application fee and $45 renewal fee are state fees (53-131). For premises inside Omaha, Ralston, Waterloo, Valley or Bennington, that municipality's governing body is the local governing body. Contact the Douglas County Clerk/Comptroller, Omaha-Douglas Civic Center, 1819 Farnam Street, H08 (Harney St level), Omaha, NE 68183.

Special Designated Liquor License, Douglas County local recommendation (events outside city and village limits)

A business serving alcohol at an event outside city and village limits under a Special Designated Liquor License (SDL) needs Douglas County's local approval first. The Clerk's Liquor and Tobacco Licenses page states: "You need to have local approval from Douglas County before you can submit your application on-line to the NLCC", and that the Commission rejects an SDL application not submitted at least 7 working days before the event (not counting the event date, holidays or weekends). The applicant submits a Special Designated License Local Recommendation Form to the Clerk's office, which places it on the County Board's agenda; once approved, the Clerk emails the form back and the applicant submits the signed form to the Commission, so the Board's meeting dates matter for the deadline. The page also states: "Douglas County does not recommend approval for SDL applications for events taking place in the city/village limits of Omaha, Ralston, Waterloo, Valley, or Bennington"; events there need that city's or village's recommendation. Contact the Douglas County Clerk/Comptroller, Omaha-Douglas Civic Center, 1819 Farnam Street, H08 (Harney St level), Omaha, NE 68183.

Retail Food Establishment Permit

The agriculture department's own fee schedule bands by establishment type and can change from year to year, but its published limited-retail figure sits at $122 for the initial permit and the same $122 annually after that, with each additional food preparation area adding $61. An establishment already operating before applying pays a further $60. This is not a statewide-only programme: applications for Lancaster, Douglas or Hall counties are forwarded to those counties' own delegated health departments — Lincoln-Lancaster County Health Department and Douglas County Health Department in Omaha each run their own inspection and permitting programme rather than the state administering it directly.
