What does a restaurant need in Atlanta that other businesses do not?
1 of the 8 permits particular to a restaurant here applies to no other business type we cover in Atlanta: Alcoholic Beverage License — Consumption on Premises.
Food Service Permit — DeKalb County
Applies only to the DeKalb County portion of Atlanta. DeKalb Public Health also runs its own in-house Certified Food Safety Manager course for $150 including the book and exam, priced separately from this facility permit.
Right-of-Way (Sidewalk / On-Street) Dining Permit
Applies only to an eating and drinking establishment that places tables in the public right-of-way (sidewalk or on-street). City Code Sec. 138-233(a) makes it unlawful to operate a right-of-way dining area without a permit from the commissioner of the Department of Transportation. Fees are from Sec. 138-234 as amended by Ord. 2025-30 (8-18-25): '(8) Application fee of $250.00' and '(b) The annual right-of-way dining permit fee shall be $500.00 annually for the use of up to 250 square feet ..., $750.00 annually for ... 250—500 square feet ..., and $1,000.00 annually for ... over 500 square feet'. The application needs the City Occupational Tax Certificate, insurance, a to-scale site plan keeping five feet of pedestrian clearance, and the permit is non-transferable.
Food Service Wastewater Discharge (Grease Trap) Permit
City Code Sec. 154-297.01(a): the operator of a food processing, sales or service establishment discharging wastewater to the City sewer 'shall obtain a food service wastewater discharge permit', obtained 'prior to the issuance of any business license issued by the city'. The fee table in Sec. 154-297.01(a)(1) runs from '0—5 $300.00' to '56—60 3,600.00'; (a)(2) sets the $100 per trap re-inspection fee; (a)(3) lets the commissioner adjust the fees administratively by less than 10% a year with notice. The Department of Watershed Management's Grease Management page lists the same fees ('0-5 $300', '6-10 $600' through '36-40 $2,400') and says all food service facilities must apply, pay permit fees and be available for inspections.
Alcoholic Beverage License — Consumption on Premises
License fees are from the City Code, Sec. 10-60(a) as amended by Ord. 2024-44 (10-21-24): retail dealer in wine or in beer for consumption on or off the premises $2,500 each; consumption on the premises of distilled spirits, wine and malt beverages $5,000 initial license and $5,000 for each additional facility license (restaurant patios immediately adjacent to the restaurant are exempt from the additional facility fee). Sec. 10-61: a new license granted after June 30 pays 50% of the annual fee. Sec. 30-28 Schedules 1 and 2 set the $300 initial and $150 renewal application fees; Sec. 10-32(b) adds a $50 buildings inspection fee and a $50 fire inspection fee. The Atlanta Police Department's alcohol license page lists the same annual fees ('BEER AND WINE CONSUMED $5,000.00', 'BEER CONSUMED $2,500.00', 'WINE CONSUMED $2,500.00'), a $20 fingerprint fee and the $300 filing fee. Applications go through the License Review Board to the Mayor (Sec. 10-46); a Georgia Department of Revenue license is also required.
