Business licenses and permits in Santa Clara County, California
Santa Clara County has 15 incorporated cities and a small unincorporated area (including San Martin), and its county-level regulators split that geography in several different, non-overlapping ways. The County issues no general business license at all — a business inside any incorporated city is licensed only by that city, and a business in the unincorporated area needs no county business license either. Zoning, use-permit and the County Fire Marshal's Office's childcare fire-clearance function, all under the Department of Planning & Development, reach the unincorporated area only. The Santa Clara County Fire Department (SCCFD), a joint-powers district, serves seven cities — Campbell, Cupertino, Los Altos, Los Altos Hills, Los Gatos, Monte Sereno and Saratoga — plus the unincorporated area; the other eight cities (San Jose, Santa Clara, Sunnyvale, Mountain View, Palo Alto, Milpitas, Gilroy, Morgan Hill) run independent fire departments outside SCCFD's footprint. The County Department of Environmental Health (DEH) runs food-facility, mobile-food, temporary-food, body-art and medical-waste programs countywide, reaching all 15 cities and the unincorporated area alike. Hazardous-materials CUPA registration and the Underground Storage Tank program are fragmented differently again: DEH is the default Certified Unified Program Agency for most of the county, but the cities of Santa Clara, Sunnyvale and Gilroy each run an independent CUPA, and Palo Alto, Mountain View and (on weaker sourcing) San Jose operate as Participating Agencies under DEH while DEH remains the CUPA of record — Milpitas is not independent, having reverted to County DEH on July 1, 2018. The Bay Area Air Quality Management District, a nine-county regional agency rather than a county office, reaches every part of Santa Clara County with no city/county split. Animal-control field service is fragmented by city among County Animal Services, the Silicon Valley Animal Control Authority and San José Animal Care Services, but the county ordinance exempting state-licensed veterinary hospitals from the commercial-kennel license applies regardless of which of those three provides day-to-day animal control locally. The Sheriff's Office issues a $25 One-Day Liquor Permit in the unincorporated area plus the contract cities of Saratoga, Cupertino and Los Altos Hills and on Stanford University lands — a different, wider footprint than the county's own zoning/CUP alcohol layer, which is unincorporated-area-only. State-level credentials — the CSLB contractor license, Bureau of Automotive Repair registration, Board of Barbering and Cosmetology licenses, the Veterinary Medical Board's practice and premises licenses, CDSS Community Care Licensing for childcare, and the ABC liquor license itself — are all carried at the state layer, not here.

- Fitness studiosPrepaid memberships trigger state registration and often a surety bond, which catches operators who budgeted only for the fit-out.See the full permit list
- Childcare centresThe heaviest permit load of any small business: state agency licensing, per-person background checks, and a stricter fire standard than ordinary commercial use.See the full permit list

- Veterinary clinicsA state facility permit, controlled substances registration at both state and federal level, and a medical waste manifest — none of which a general business license covers.See the full permit list

What do these permits involve in Santa Clara County?
Zoning Clearance / Discretionary Use Permit / Architecture & Site Approval
This is the unincorporated-area-only land-use layer of the county: any new commercial use, change of use, or qualifying construction or tenant-improvement project on unincorporated Santa Clara County land needs a zoning clearance from the Department of Planning & Development, and many commercial uses need a discretionary Use Permit and/or Architecture & Site Approval on top of that; a limited set of low-intensity uses, such as qualifying home occupations, are allowed by right. Auto-repair has an explicit use table under Zoning Ordinance §2.40.020: it is not allowed in neighborhood-commercial or administrative/professional-office zones, is allowed in general-commercial zones with a Use Permit, and is allowed in light- or heavy-industrial zones with Architecture & Site Approval. A childcare centre sited in a residential zone commonly triggers a discretionary Use Permit, with the specific zoning-district threshold set case by case by County Planning. Application fees are set by the Board of Supervisors as part of the department's own fee schedule and vary by permit type and project size rather than by a single flat county-code figure. A food-truck operator only falls under this record if its commissary or base of operations sits on unincorporated county land; each of the 15 incorporated cities runs its own separate zoning process for a business physically located inside city limits.
Fire-Prevention / Fire-Code Operational Permit (SCCFD)
The Santa Clara County Fire Department (SCCFD) is a joint-powers fire-protection district that serves seven incorporated cities — Campbell, Cupertino, Los Altos, Los Altos Hills, Los Gatos, Monte Sereno and Saratoga — plus the unincorporated area, including San Martin. The other eight incorporated cities in the county (San Jose, Santa Clara, Sunnyvale, Mountain View, Palo Alto, Milpitas, Gilroy and Morgan Hill) each run their own independent fire department and are outside SCCFD's service area entirely. Within its service area, SCCFD's fire-prevention function issues permits for assembly occupancies (covering sprinklers, extinguishers, exits and occupancy limits) and reviews construction and tenant-improvement plans for fire-code compliance, reaching restaurants, coffee shops, fitness studios and other assembly uses, retail stores, childcare facilities, auto-repair shops handling hazardous materials, veterinary clinics, salons and contractors storing materials at a yard. A food-truck operator falls under this record only if its commissary is based within SCCFD's service area. SCCFD does not publish a flat fire-permit fee schedule; instead, its Permit Technician issues an invoice after reviewing a submitted plan for completeness, so the amount depends on the scope of review and inspection each project needs. Separately, County Planning's 'Fire Marshal's Office' performs fire-clearance and plan-review functions tied to Planning applications specifically in the unincorporated area (see the childcare fire-clearance record); this page describes each office's functions by geography.
General Business License — Santa Clara County position
No fee applies. Santa Clara County's own Department of Planning & Development states plainly that no county business license is required to operate in unincorporated Santa Clara County. This affirmative no-license position covers only the unincorporated area — San Martin and the other unincorporated pockets of the county — because every one of the county's 15 incorporated cities (San Jose, Santa Clara, Sunnyvale, Mountain View, Palo Alto, Milpitas, Gilroy, Morgan Hill, Campbell, Cupertino, Los Altos, Los Altos Hills, Los Gatos, Monte Sereno and Saratoga) runs its own separate city business-tax or business-license scheme, which is not covered on this county page. What the County does license and permit is a specific, named list of programs — zoning and use-permit review, DEH's food, body-art, medical-waste and hazardous-materials programs, fire-prevention permits through the County Fire Department, and a handful of others — each listed separately where it reaches one of the ten industries covered here.
