What does a contractor or trade need in Etowah County Al that other businesses do not?

5 of the 6 permits particular to a contractor or trade here apply to no other business type we cover in Etowah County Al: Contractor Privilege License (Ala. Code §40-12-84), Floodplain Development Permit (Special Flood Hazard Areas), Major Subdivision Fees (Permit to Develop and Plat Review) and 2 more.

Contractor Privilege License (Ala. Code §40-12-84)

Section 40-12-84 is issued by the Judge of Probate of the county of the contractor's principal office, and one county's license covers the contractor statewide. The amount depends on the contractor's gross contracts, from $16 at $5,000 to $10,000 up to $376 above $200,000, printed as combined state and county totals in the October 2022 ALDOR Handbook. The county's own pages publish no fee table, so call the Probate Office at (256) 549-5337 for the amount due at purchase. This privilege license is separate from the state contractor license issued by the state licensing boards, and from any municipal license and building permit where the work is inside a city.

Floodplain Development Permit (Special Flood Hazard Areas)

Under the Etowah County Floodplain Development Ordinance (document dated February 20, 2024), a Floodplain Development Permit is required before any development, including buildings, grading, filling, paving, excavation and storage of equipment or materials, in identified Special Flood Hazard Areas and Community Flood Hazard Areas. The County Engineer is the Floodplain Administrator, at 402 Tuscaloosa Ave., Gadsden, 256-549-5358. The permit is valid one year from issue and is void if work is not begun within 180 days; the penalty for violation is a fine of up to $500 or imprisonment. The county's three-page permit application states no fee. Inside a municipality, the city's own floodplain rules apply.

Major Subdivision Fees (Permit to Develop and Plat Review)

A contractor or developer dividing land in Etowah County under the Commission's Subdivision Regulations pays a permit to develop of $25, plat review of $500 per submission, $25 per lot and $0.75 per linear foot of road for a major subdivision; a minor subdivision has no fee. The regulations were adopted by resolution of May 5, 2009 and cite Ala. Code §11-24-3. The county's License Inspectors enforce the regulations, with a fine of $1,000 per lot sold, offered, transferred or leased in violation. This applies to land developers, not to an ordinary tenant business. Plats inside a municipality follow that city's own subdivision rules.

General Contractor License

The threshold moved on 1 October 2024 and a lot of published material has not caught up: the license is required where the cost of the undertaking is $100,000 or more, raised from $50,000, and the same figure applies to public and private work and to subcontractors. Swimming pools have their own much lower trigger at $5,000. Two official documents still say $50,000 — the board's own rule 230-X-1-.09 and its 2022 subcontractor instructions — and the statute controls. A subcontractor pays exactly half of everything: $150 new and $100 to renew against $300 and $200. Renewing more than ninety days late costs another $50. Your bid limit is set from your financial statement at ten times the lesser of net worth or working capital, which sorts licensees into classes from $100,000 up to unlimited. Residential work belongs to the Home Builders board instead, and the privilege license banded by contract value is owed on top.

Residential Home Builder License

Residential building is a separate board with a much lower trigger than the general contractor one: $10,000 for building work and just $2,500 for residential roofing. Two hundred and fifty dollars a year covers the $235 license and the $15 homeowners' recovery fund contribution, with $100 more for a new applicant's first year; a roofing-only license is $150 with no recovery fund fee. The boundary between the two boards is jurisdictional rather than financial — the general contractor statute exempts residences and private dwellings, and this board's remit stops at structures no more than three floors high with no more than four residential units, above which it reverts. There is a grandfathering quirk worth checking: general contractor license numbers up to 18907, issued before this board existed in 1992, may still do residential work, while 18908 and above may not. The three tiers turn on scope, not money — a single trade not affecting structural integrity is limited, anything structural or spanning trades is unlimited, and roofing has its own class with a $10,000 bond and no examination.
