About each permit

Child Day Care Facility Inspection Fee

Under Sanitary Code §873.2119 the fee for an inspection of a child day care facility licensed or registered by the New York State Office of Children and Family Services is $300.00. The county's May 1, 2026 fee sheet lists the same $300 charge. The codification history line printed under §873.2119 does not show the February 19, 2026 amendment that the other Article XXI sections carry, so the $300 figure is taken from the section text and the fee sheet. The charge is per inspection rather than per year.

Septic System Contractor License (original and biennial)

Under Sanitary Code §873.722 A(1), each person who provides or offers to provide services as a septic system contractor in Westchester County must hold a license from the Commissioner of Health. The licensing fees are set in the licensing paragraph under §873.2111 of Article XXI (Article XXI, Supp. No. 47, amended February 19, 2026 and in effect from May 1, 2026): $300 per septic contractor applicant on the original application and $300 per licensed septic contractor on each biennial license or renewal. The county's May 1, 2026 fee sheet lists the same figures. The license applies to a business that installs, repairs or services onsite septic systems. Septage collector and septage vehicle licenses are set in the same schedule and are not part of this record.

Food Service Establishment Permit (eating place, delicatessen, caterer, commissary, retail bakery)

The Westchester County Department of Health issues this permit under Sanitary Code §873.441, which requires a permit before a food service establishment operates in the county. Chapter 873 defines food service establishments to include eating places, delicatessens, caterers, commissaries, retail bakeries and day care centers (§873.420.1(1)(c)), so a day care center that provides food falls within this fee table. The fee table is set in Article XXI §873.2103 (Article XXI, Supp. No. 47, amended February 19, 2026 and in effect from May 1, 2026), and the county's May 1, 2026 fee sheet lists the same figures. The 2026 application states that the fee may be adjusted on inspection: "Fee due may be adjusted by this Department upon inspection when the appropriate category and seating capacity are incorrect." The application must be filed no later than 21 days before operation begins.

Plan Review, Food Service Establishment

Sanitary Code §873.421(1) requires prior written approval of plans before a food service establishment is constructed or modified. The plan review fee is set by seating capacity in Article XXI §873.2103 (Article XXI, Supp. No. 47, amended February 19, 2026 and in effect from May 1, 2026): $310 for 0 to 100 seats, $410 for 101 to 200 seats and $525 for 201 seats or more. Each subsequent review is charged separately at $105. The county's May 1, 2026 fee sheet lists the plan review charge under the food service establishment heading.

Temporary Food Service Permit (less than 15 days per calendar year)

Sanitary Code §873.441 requires a permit for a food service establishment, and §873.2103 sets the temporary food service permit for operation of less than 15 days in a calendar year at $105. The charge is in Article XXI (Article XXI, Supp. No. 47, amended February 19, 2026 and in effect from May 1, 2026) and appears in the county's May 1, 2026 fee sheet. Because the permit is limited to less than 15 days in a calendar year, the length of the operation is part of the permit's scope and a longer seasonal operation is outside it.

Animal Facility Permit (pet grooming salon, kennel, pet shop)

Under Sanitary Code §873.1903, a person who owns, leases or otherwise engages in the business of maintaining an animal facility may not do so without a permit issued by the Commissioner. §873.1901(2) defines an animal facility as a location or business where live animals are sold, offered for sale, given away, exchanged, bartered, sheltered, boarded, stabled, exhibited, bred, trained or groomed, other than a private home, zoological park, aquarium, laboratory, or educational or scientific institution. The fees are set in Article XXI §873.2108 (Article XXI, Supp. No. 47, amended February 19, 2026 and in effect from May 1, 2026). A pet grooming salon, a kennel and a pet shop each require this permit. A salon that styles human hair does not groom live animals and falls outside the definition.

Swimming Pool, Spa and Bathing Beach Permit (operating fee and plan approval)

Under Sanitary Code §873.1200 no person may operate a swimming pool without a valid permit issued by the department, and §873.1201 applies the permit requirement to bathing beaches. The operating and plan approval fees are set in Article XXI §873.2105 (Article XXI, Supp. No. 47, amended February 19, 2026 and in effect from May 1, 2026). The annual operating fee is $835 for a swimming pool with 50 or more persons and $410 for a swimming pool under 50 persons, a spa or whirlpool, a wading pool or a bathing beach. Plan approval for a new pool is $1,035 per swimming pool and $835 per wading pool. The permit applies to a fitness studio that operates a pool or spa.

Mobile Food Unit Permit (food truck)

Sanitary Code §873.491(1) provides that no person may engage in the business of operating a mobile food unit without first obtaining a permit from the department. The $400 fee is set in Article XXI §873.2103 (Article XXI, Supp. No. 47, amended February 19, 2026 and in effect from May 1, 2026) and appears in the May 1, 2026 fee sheet. Under §873.491(4), the route is filed with the application and significant route changes are reported within ten days. Under §873.491(2), the unit's name, address and permit number must be displayed on both sides in letters not less than four inches tall. Under §873.491(3), a food vendor operating as part of a permitted food service establishment does not need a separate mobile food unit permit.

Petroleum Bulk Storage and Used-Oil Tank Registration

Article XXV of the Sanitary Code (§873.2501 et seq.) requires the facility owner to obtain a registration before the first receipt of petroleum into a new or replaced tank system (§873.2501.9(a)), and to renew it every three years (§873.2501.9(c)). The registration applies to tank systems with a combined storage capacity of more than 1,100 gallons, and to any used-oil tank system subject to 6 NYCRR Subpart 374-2 regardless of size (§873.2501.3(x)(1)). Whether an auto-repair shop's used-oil tank falls under Subpart 374-2 depends on that tank, so the registration applies to a shop only where its tank meets that test or the 1,100-gallon threshold. The fee is set by the Commissioner's schedule under §873.2501.7.
