About each permit

Veterinary Licensing — State License Applies (Nassau County)

The New York State Education Department's Office of the Professions licenses veterinarians — its License Requirements page states 'The fee for licensure is $372' — and the Department of Consumer Affairs' Licensing & Registrations page lists no veterinary category, so there is no county veterinary license fee. Rabies vaccination proof is required by state Public Health Law as a precondition for dog licensing, but dog and animal licensing itself is a town function in Nassau County — the Town of Hempstead, Town of Oyster Bay and Town of North Hempstead each run their own animal-control and licensing programs, not the county. Regulated medical waste from a veterinary practice is a New York State DEC/DOH matter for the off-site treatment facility, not a permit for the generator itself, though the county's Toxic and Hazardous Material Storage Registration and Inspection Program can reach a clinic's on-site chemical storage the same way it would any commercial facility storing regulated chemicals. A veterinary practice that also boards or grooms animals commercially would separately fall under the Department of Consumer Affairs' Pet Grooming category if it runs a self-service or standalone grooming operation.

Food Service Establishment Permit — Mobile Food Service Establishment

A food truck or other mobile food unit operating regularly in Nassau County — as opposed to a one-off appearance at a single event, which uses the temporary permit recorded separately — needs its own mobile Food Service Establishment permit from the Nassau County Department of Health, priced in the county's 2012 fee schedule at $435 a year. Unlike a fixed establishment's discretionary term, a mobile permit's annual renewal cycle is set by a separate rule, NYS Sanitary Code Subpart 14-2, and is confirmed as a fixed annual term rather than the 2-year discretionary ceiling that applies to fixed establishments. A mobile unit that also uses LP gas for cooking equipment separately needs a Fire Marshal's Office LP-gas system permit, recorded under the Fire Prevention Ordinance entry for Nassau County, and is subject to a 200-pound aggregate LP-gas cap and NFPA 58 compliance regardless of where in the county it operates.

Swimming Pool and Bathing Beach Operating Permit

A fitness studio or gym operating a swimming pool, and a childcare facility with an on-site pool, need a Nassau County Department of Health operating permit for it, filed at least 30 days before the permit expires or, for a new pool, before it opens. The 2012 fee schedule — dated August 1, 2012, the same document cited for the Food Service Establishment fees — prices a seasonal pool up to 5,000 square feet at $535 and a larger seasonal pool at $750, an annual pool up to 4,000 square feet at $970 and a larger annual pool at $1,315, and a bathing beach at $345, on top of a flat $150 non-refundable application fee. Plan review for a new pool is $1,500 and for a pool renovation is $500. A facility with no pool, spa or beach has no obligation under this record.

Food Service Establishment Permit — Fixed (Standard) Establishment

Any restaurant, cafe, deli, tavern or other fixed establishment that prepares or serves ready-to-eat food for on- or off-site consumption needs a Food Service Establishment permit from the Nassau County Department of Health before opening, applied for in person at the Office of Food Protection, 200 County Seat Drive (North Entrance), Mineola. The permit's term is not a fixed annual cycle: NYS Sanitary Code §14-1.192 caps a permit at 2 years and leaves the actual term to the permit-issuing official's judgment based on the establishment's compliance record, its risk category, and its self-inspection program — some fixed establishments are issued shorter terms, and the county's own 2012 fee schedule itself lists a bar/tavern permit as a 'two year permit.' High-risk establishments must staff a Nassau County-certified food manager, and any location open more than 12 continuous hours needs a second certified manager. Application requires a corporate seal or EIN, officer names and addresses, and Workers' Compensation/Disability insurance certificates naming the Nassau County Department of Health. Mobile units use a separate permit and a confirmed annual term, recorded in the next entry.

Temporary Food Service Establishment Permit (fairs, festivals, special events)

A food or drink concession set up at a fair, festival or other special event — rather than operating regularly at a fixed or mobile location — is classified a Temporary Food Service Establishment under NYS Sanitary Code Subpart 14-2 and needs its own permit from the Nassau County Department of Health for that event. The application and fee are due at least 3 full business days before the event begins, and a late submission adds a late fee on top of the base charge; once paid, the fee is non-refundable and non-transferable even if the event is cancelled. Operational rules for temporary vendors include a ban on home-prepared or home-stored food, a requirement for overhead coverings on outdoor booths, and a ban on bare-hand contact with ready-to-eat food. A food truck that instead operates regularly at the same location, rather than at a single temporary event, needs the mobile Food Service Establishment permit recorded separately for Nassau County instead of this one.

Food Service Establishment Permit — Day Care Exemption under 10 NYCRR 14-1.190(g) (Nassau County)

Under NYS Sanitary Code §14-1.190(g), no fee applies and no separate Food Service Establishment permit is required when a licensed day care center serves food to its own enrolled children in-house — this is a categorical exemption, not a quantity or frequency threshold. NYS Sanitary Code §14-1.190(g) states plainly that day care centers approved to operate by the state (now the Office of Children and Family Services, successor to the Department of Social Services named in the rule's text) 'do not require a separate permit for food service operations unless such operations are conducted by a third party.' The regulation states no seat count, meal count or hours-of-operation limit: a center feeding its own children stays exempt regardless of volume. The exemption flips the moment a third-party caterer or vendor runs the food service instead of center staff — at that point the third-party operator, not the childcare center, is responsible for applying for and holding its own Food Service Establishment permit from the Nassau County Department of Health.

On-Site Sewage Disposal System Plan Approval / SPDES Coordination

Nassau County is overwhelmingly served by public sanitary sewers, and where public sewer is available the County Health Commissioner can order a property to connect to it. On-site sewage disposal system plan approval from the Nassau County Department of Health applies only to a commercial facility not connected to public sewer, and only where its design flow reaches 1,000 gallons per day or more — a small minority of Nassau County commercial sites, mostly isolated properties in far-eastern unincorporated pockets of the county. Special Groundwater Protection Areas under Article X of the Public Health Ordinance add further development-density and discharge limits in the areas they cover, layered on top of, not instead of, the sewage-disposal plan-approval requirement. A business connected to public sewer — the case for the large majority of Nassau County commercial addresses — has no obligation under this record at all.

Indoor Tanning Facility Permit

A salon or standalone facility offering indoor tanning in Nassau County is permitted and enforced by the Nassau County Department of Health rather than a state agency. The county's own Administrative Code has carried tanning-facility provisions since Local Law 3-2005, and the Department of Health's own Board of Health enforcement documents define 'TAN' as one of its own program codes for 'Tanning Salon' — the department actively inspects and fines tanning salons under its own authority using that code, which identifies the county Department of Health, rather than the New York State Department of Health, as the issuing and enforcing agency for this permit. A salon offering no tanning services, only hair, nail or skin services, has no obligation under this record.
