Retail Tobacco and ENDS License (premises outside city and village limits)

Under Neb. Rev. Stat. 28-1421 and 28-1422, a business selling cigarettes, cigars, tobacco or electronic nicotine delivery systems at retail needs a license; for a location outside the limits of any city or village, the application is made to the county clerk, here the Buffalo County Clerk. The fee is set by state statute: 28-1423 fixes the retail license fee at $10 in cities other than metropolitan, primary and first-class cities, in towns and villages, and in locations outside the limits of cities, towns and villages, and at one-half that amount if the application is made after July 1. The County Clerk's fee list shows "Tobacco license (County)" at "$10.00 per year", matching the statute. The license runs from filing and payment through December 31 of the calendar year in which the application is made, so it is renewed each calendar year. A store, restaurant or coffee shop selling tobacco or vapour products inside a city or village applies to that city or village clerk under the same statute.
