About each permit

Temporary and Multiple-Location Temporary Food Permit

Section 114.015-B requires a temporary permit for food service at a single event or celebration, valid for that event only and not more than 14 days. The fee depends on the risk level the Health Department assigns: $72 low, $108 medium, $162 high. The application and payment must arrive at least 7 days before the event or a $50 late fee applies, and the fee is doubled if the application is received 3 days or less before the event. An operator working several events can instead buy a multiple-location temporary permit, valid April 1 through October 31, at $350 (low risk) or $550 (medium risk); Appendix A states it "does not include High Risk", and it carries the same $50 late fee. Figures are per Appendix A of the Will County Food Establishment Sanitation Ordinance (County Code ch. 114), adopted June 16, 1988 and "Amended and Effective October 1, 2024", as linked from the Health Department's Ordinances page; the Department's Guide for Temporary Permits shows the same amounts. Non-profit, benevolent, charitable or community organisations pay 50% of temporary permit fees, and temporary permit fees are non-refundable.

Food Establishment Permit

Section 114.015-A of the Food Establishment Sanitation Ordinance makes it unlawful to operate a food establishment "within Will County in the State of Illinois" without a valid permit from the Health Authority, so a restaurant or coffee shop inside a city or village holds this county permit as well. The annual fee is set by seating: $306 for carry-out up to 40 seats, $480 for 41 to 100 seats and $876 for 101 seats and over, with commissaries and caterers at $876 and a school milk cooler only at $60, per Appendix A of the Will County Food Establishment Sanitation Ordinance (County Code ch. 114), adopted June 16, 1988 and "Amended and Effective October 1, 2024", as linked from the Health Department's Ordinances page. Permits run January 1 through December 31; a permit issued after July 1 costs half the annual fee (§114.015-E), the renewal fee not received by December 31 carries a 25% late penalty (§114.015-F), and a new operator who opens before obtaining a permit pays the annual fee plus 25% (§114.015-G). Governments, schools and churches pay 50%, but §114.015-C states that the school discount does not apply to day care centers or preschools. The permit is not transferable and must be posted for public display.

Food Establishment Plan Review

Under §114.075-A, plans and specifications must be submitted to the Health Department for review and approval whenever a food establishment is constructed or remodeled or an existing structure is converted to food use, before the work begins, and "No building permit for any such construction or remodeling shall be issued until and unless the Health Authority has given approval in writing." The plan review fees for food service establishments are $228 for a minor plan review, $312 for 0 to 40 seats, $474 for 41 to 100 seats, $684 for 101 seats and over and $684 for commissaries and caterers; a priority review answered within 7 days costs twice the applicable fee. Figures are per Appendix A of the Will County Food Establishment Sanitation Ordinance (County Code ch. 114), adopted June 16, 1988 and "Amended and Effective October 1, 2024", as linked from the Health Department's Ordinances page. Plan review fees are non-refundable. Retail food store and mobile unit plan review fees are listed in their own records.

Retail Food Store Permit and Plan Review

A retail store that sells food needs a Health Department permit wherever it sits in Will County. Appendix A prices retail food stores by floor area: $264 under 250 square feet (prepackaged time/temperature-controlled-for-safety food only, as a minor business component), $306 for 250 to 5,000 square feet, $480 for 5,001 to 10,000 square feet and $876 for 10,001 square feet and over. Plan review for a new or remodeled store costs $228, $264, $420 or $630 for the same four bands. Figures are per Appendix A of the Will County Food Establishment Sanitation Ordinance (County Code ch. 114), adopted June 16, 1988 and "Amended and Effective October 1, 2024", as linked from the Health Department's Ordinances page. The permit runs January 1 through December 31 with the same half-year, late-penalty and 50% government/school/church rules as other annual food permits.

Mobile Unit Permit (Food Trucks and Push Carts) and Plan Review

The Health Department's Mobile Unit/Food Trucks page states that all mobile food service operators must apply for an operating permit from the Will County Health Department. Appendix A sets $250 for push carts for frozen novelties, $325 for a mobile unit without preparation and $450 for a mobile unit with preparation, per calendar year. Plan review costs $264 for a unit without preparation and $420 for a unit with preparation; the plan review row for "Push Carts for Frozen Novelties/Hot or Cold Holding Mobile food trucks" reads "N/A". Figures are per Appendix A of the Will County Food Establishment Sanitation Ordinance (County Code ch. 114), adopted June 16, 1988 and "Amended and Effective October 1, 2024", as linked from the Health Department's Ordinances page, and the current application form (EH-Form-013) prints the same amounts. The page also requires a daily return to a licensed, inspected commissary kitchen for cleaning and re-supply, a signed commissary agreement and the vehicle registration with the application, and operational supervision by a Certified Food Protection Manager.

Public Swimming Facility License

A fitness studio, club or childcare centre that operates a public swimming facility needs an annual license from the Will County Health Department to open to the public; §97.04-D applies the ordinance and its fees "to all public swimming facilities in Will County". Appendix A sets a $300 swimming facility licensure fee and states: "Where there is more than one feature at the same location and under the same ownership, an additional flat fee of $75 shall be charged." A bathing beach license is $250, a re-inspection $50 and a conference $150. Figures are per Appendix A of the Public Swimming Facility Ordinance (adopted September 2009, amended August 20, 2015, revised February 14, 2018 and April 18, 2024), as linked from the Health Department's Ordinances page. The license runs May 1 to April 30, must be displayed and is not transferable to a new owner. Construction and major-alteration permits for a pool come from the Illinois Department of Public Health before the county license. A studio without a pool has no pool license.

Water Well Permit

A business served by a private well rather than a public water supply needs a Health Department permit to construct a well or closed-loop well system. Appendix A of the Water Well Permit and Water Supply Ordinance (Ord. 16-209, adopted July 21, 2016), as codified in County Code Chapter 53 and as posted on the Health Department's Ordinances page, sets $100 for the well or closed-loop well system permit and $100 for the well inspection, $25 for a reissued permit, $50 for a variance and $80 for abandonment or sealing. A business on a public water supply without a private well has no well permit.

Vending Machine Permit (Time/Temperature-Controlled Food or Open-Cup Beverages)

Under §114.015-J, vending machines that dispense time/temperature-controlled-for-safety food, or beverages into an open container, are subject to the Food Establishment Sanitation Ordinance. Appendix A sets an annual fee by the number of machines: $50 for 1 to 3, $100 for 4 to 6, $150 for 7 to 10, $200 for 11 to 14, $250 for 15 to 20 and $300 for 21 or more, per Appendix A of the Will County Food Establishment Sanitation Ordinance (County Code ch. 114), adopted June 16, 1988 and "Amended and Effective October 1, 2024", as linked from the Health Department's Ordinances page. Machines located and serviced by the operator of an establishment that already holds a Will County establishment permit are not subject to these vending fees and are permitted and inspected under that establishment permit. Machines selling only shelf-stable packaged items fall outside the section.
