Retail Alcohol License — Board of Supervisors Approval (premises outside city limits, Polk County)

Under Iowa Code §123.32(1)(a), an application for a retail alcohol license (other than class "D") is filed with the board of supervisors "if the premises for which the license is sought are located outside the corporate limits of a city"; inside a city it goes to that city council. Under §123.32(2), the local authority "shall either approve or disapprove the issuance of a retail alcohol license, shall endorse its approval or disapproval on the application, and shall forward the application with the necessary fee and bond, if required, to the department." Under §123.32(5), "A local authority located in a county with a population that exceeds three hundred thousand persons, as a condition of obtaining and holding a license for on-premises consumption, shall require the applicant or licensee to provide, and update if necessary, the occupancy rate of the licensed premises"; Polk County's population is above that figure. Iowa Code §123.36(2) provides that the department "shall remit to the appropriate local authority a sum equal to sixty-five percent of the fees collected for each class "B", class "C", or class "F" license except special class "C" licenses or class "E" licenses" and "a sum equal to seventy-five percent of the fees collected for each special class "C" license."
