About each permit
Air Construction Permit, Spray-Booth Permit by Rule and Annual Minor Source Operating Permit (Polk County Air Quality)
Polk County Board of Health Rules Chapter V (effective April 14, 2025), administered by the Air Quality Division, applies inside cities as well as the unincorporated area. Unless exempt under §5-33, no person may construct, install, reconstruct or alter equipment or control equipment without first obtaining a construction permit (§5-28), and no person may operate equipment without a minor source operating permit (§5-35), which "shall be renewed annually by December 31st of each year for the following calendar year" (§5-36). For auto body and refinish shops, §5-28.1(1) sets a spray-booth permit by rule: a facility spraying one gallon per day or less must submit the rule's certification and keep daily records; more than one and up to three gallons per day adds venting through a stack at least 22 feet tall; more than three gallons per day must apply for a construction permit. The rule states that an owner or operator required to apply for a permit by rule "shall submit fees as required in Sections 5-34 and 5-35.1." Operating permit fees are set by Board of Supervisors resolution (§5-35.1(2)). As published in the 2026 Permit Fee Schedule that the county's Air Quality Forms & Resources page labels "Effective 1/1/2026": Minor Source Construction Permit $672.00; Minor Source Modeling Review $613.00; operating permit $111.00 for each emission point; fuel burning equipment $111.00 up to 2,500,000 btu per hour and $404.00 above; a late fee of 10% of the permit fee after January 20th of the permit year. Gasoline Dispensing Facility Operating Permit (Polk County Air Quality)
A convenience or other retail store that dispenses gasoline anywhere in Polk County, inside a city or not, falls under the Air Quality Division's operating permit rules in Board of Health Rules Chapter V (effective April 14, 2025): §5-35 requires a minor source operating permit to operate equipment, renewed annually by December 31st for the following calendar year (§5-36). Chapter V exempts "Retail gasoline and diesel fuel handling facilities with throughput below 10,000 gallons per month" (thirty-day rolling average usage records) from the construction permit under §5-33(16), and §5-39(1) carries the §5-33 exemptions over to the annual operating permit; such a facility must be able to show the Division within 24 hours of a request that its throughput is below that limit. A store without fuel dispensing has no gasoline dispensing permit. As published in the 2026 Permit Fee Schedule that the county's Air Quality Forms & Resources page labels "Effective 1/1/2026", the operating permit fee for Gasoline Dispensing Facilities (GDF's) is $111.00 for each location, with a late fee of 10% of the permit fee after January 20th of the permit year. Questions go to Air Quality (515-286-3705).
