Special Activity Permit (Mobile Food Vendor / Street Vending)

The Department of Public Works Engineering Division's own current fillable form states 'FEE: $50' in its agency-use box, and Hawai'i County Code §22-3.10(a) sets the same figure: 'applicants shall submit a processing fee of $50.' Section 22-2.5 bars 'displaying, vending, hawking, selling' food or other goods on any County street without this permit, which the director may issue for up to one year (§22-3.3(b)); unpermitted street vending is fined $250 per incident (§22-3.4(a)). Vending is allowed only on streets the Council designates by ordinance, and §22-3.3.2 currently lists one: the makai side of Ane Keohokalole Highway in Kona between the West Hawai'i Civic Center and the 'Allied Quarry' access road, designated in March 2025 under the roadside-vending framework the Council passed as Bill 184 in October 2024. The permit requires a certificate of insurance ($1,000,000 minimum liability coverage naming the County as additional insured), proof of a valid business license or permit, and a waste-management plan, and is intended for itinerant use, so a permittee may not remain in one location beyond the period the director allows. Off County streets this permit does not apply: Chapter 6 contains no peddler or vendor license and the Zoning Code (Chapter 25), which governs what uses each lot may host, has no food-truck-specific provision, so a truck selling only on private property with the owner's permission needs no County vending permit; selling inside a County park instead needs a Parks and Recreation permit under §15-20(b), and the state Department of Health food permit recorded at the state layer applies everywhere.
