About each permit

Food Service Facility FOG Interceptor and Trap Permit

Kent County Code §180-3 provides that Chapter 180 "shall apply to all direct or indirect users of the County wastewater system with the exception of exclusions provided herein", and §180-13K(1) provides: "All food service facilities, as defined in § 180-5, shall obtain a permit under the provisions of this code." Section 180-5 defines a food service facility as any facility that "prepares and/or packages food or beverages for sale or consumption, on- or off-site", other than private residences and facilities preparing fewer than 10 meal events a month or serving one meal event a day for at most four months a year; restaurants, grocery stores and bakeries are among the listed examples. Under §180-13B every new and existing food service facility must provide grease, oil and/or sand interceptors and traps of a type and capacity approved by the Delaware Department of Health and Social Services. Each trap is serviced at least monthly unless the permit sets another frequency; interceptors must be serviced by a grease hauler licensed by the State of Delaware, and traps may be serviced by a licensed hauler or properly trained FSF employees, with a maintenance log displayed at the facility and receipts kept for two years (§180-13F). The County inspects permitted facilities yearly, and any reinspection costs $100 (§180-13I). As set in Table 128-I-1 (last amended 6-11-2024 by Ord. No. 24-14; Supp 40, Oct 2024), the application fee is $100 for owners with 100 gallons or less of total trap/interceptor volume in one facility and $400 above 100 gallons; under §180-13K(4) the fee may be waived if the facility contracts with an interceptor management system contractor or attends the Department's advanced FOG training class during the permit period. The permit must be displayed prominently. Section 180-13K(11) states: "Municipal contract users will have the authority to enforce the requirements of this code"; §180-5 names the municipal contract users as Camden-Wyoming, Dover, Milford and Smyrna. Under §128-18 connection fees are calculated per equivalent dwelling unit (EDU), with one EDU equal to 250 gallons per day or six fixture units and usage categories set out in §128-18A(3). Table 128-III-1 (last amended 6-25-2019 by Ord. No. 19-10) sets the Main System Capital Improvement Fee at $3,392 per EDU effective July 1, 2026; the table sets a new rate each July 1. Under §128-21 municipal contract users remit this charge to the County and may add an administrative fee of up to 5% for collections. The permit applies to a property connecting to the Kent County central sewer system.
