About each permit
MCHD Food Service Establishment Permit
Every restaurant and coffee shop preparing and serving food to the public in Montgomery County needs this annual permit from the Montgomery County Health Department (MCHD), Environmental Health Division, before operation. The fee tiers by seating capacity under MCHD's own Environmental Health Division Fee Schedule: $85 for 0 to 25 seats, $175 for 26 to 75 seats, and $265 for more than 75 seats. That fee schedule is printed 'Effective Date July 1, 2004,' and it is the schedule MCHD currently publishes on its own website. A late-renewal penalty of $40 and a $30 returned-check fee apply under the same schedule. This permit is separate from, and in addition to, the county general privilege license recorded as a separate requirement.
MCHD Public Swimming Pool / Spa Permit
A fitness studio, gym or health club operating a swimming pool, spa or hot tub in Montgomery County needs this annual permit from MCHD, priced at $85 a year under MCHD's own Environmental Health Division Fee Schedule (the same schedule, printed 'Effective Date July 1, 2004', that MCHD currently publishes). The Montgomery County Board of Health holds real, independent local rule-making authority for this program — its 2018 pool and spa rules, adopted February 15, 2018, expressly cite Ala. Code §§22-3-2(4) and 22-3-2(10) as the source of that authority, and adopt Chapters 3 through 6 of the 2015 ICC pool/spa code by reference — even though the dollar fee itself lives in the older, confirmed-unchanged 2004 fee document; both facts are true at once. The rule document names only 'the City of Montgomery Building Department, or other municipality' as the pool-construction plan reviewer; for a pool built in the unincorporated area, confirm the plan-review office with the Montgomery County Engineering Department. A studio without a pool, spa or hot tub has no obligation under this program.
MCHD Mobile Food Unit Permit
A food truck, cart or trailer operating in Montgomery County needs its own MCHD permit, and its commissary (the fixed base facility it services from) needs a separate permit as well, under MCHD's own Mobile Food Guidelines, revised February 23, 2017. The guidelines require the unit to be self-contained with potable-water and wastewater tanks unless it handles only prepackaged food, and set out detailed construction and operational requirements, but they publish no distinct annual dollar fee for the mobile-unit permit itself — the only dollar figure anywhere in the guidelines is a $115 plan-review fee charged when a unit changes commissaries. A one-off event instead uses MCHD's temporary food permitting process rather than this ongoing mobile-unit permit.
MCHD Retail Food Service Permit
A retail store in Montgomery County that prepares or handles food for sale on-site — for example a grocery deli counter or a market selling prepared foods — needs this annual Retail Food Service permit from MCHD, priced by store size under MCHD's own Environmental Health Division Fee Schedule: $85 for under 2,500 square feet and $175 for 2,500 square feet or more. As with the food establishment permit, this fee schedule is printed 'Effective Date July 1, 2004' and is the schedule MCHD currently publishes on its own website. A retail store that only resells sealed, already-packaged food made elsewhere does not need this particular permit.
MCHD Day Care Health Permit
A Montgomery County childcare center that prepares or serves food on-site needs this MCHD day care health permit, in addition to its state Department of Human Resources childcare license, recorded at the state layer. MCHD's own Environmental Health Division Fee Schedule prices this by enrollment: $85 a year for 40 children or fewer, and $175 a year for more than 40 children. This is the same MCHD fee schedule, printed 'Effective Date July 1, 2004', that MCHD currently publishes on its own website. A childcare center that neither prepares nor serves any food on-site would not trigger this particular MCHD permit, though it would still need its state DHR license.
