What does a restaurant need in York County Sc that other businesses do not?

York County Local Hospitality Tax — Registration and Remittance (unincorporated area)

County Code §35.131(A) (Ord. 4506, passed November 6, 2006) levies a county local hospitality tax of 2% of the charges for food and beverages on the sales of prepared meals and beverages sold in establishments, including establishments licensed for on-premises consumption of alcoholic beverages, beer and wine, within the unincorporated area of the county. The county's Hospitality Tax page states that collection began on November 6, 2006, and lists among taxable items fountain and frozen drinks, coffee, tea, hot chocolate and cappuccino, prepared sandwiches and salads, and bakery items that are prepared or modified. A business registers on the county's Hospitality Tax Registration Form, which asks for the date opened, the estimated monthly sales subject to the tax and the state retail license number, and shows no registration fee. Under §35.132(A) the tax is remitted to the county treasurer monthly when the estimated average tax is more than $50 a month, quarterly at $25 to $50 a month and annually under $25 a month. Per the county's Hospitality Tax page, payment is due in the Treasurer's Office or postmarked by the 20th day of the month after the reporting period closes, and a return filed after the due date owes a 5% penalty per month or portion thereof on the original tax due; the Reporting and Computation Form computes that penalty as Line 4 x .05 and states that payments are delinquent on the 21st of the following month. In the County Code, §35.999(C) makes failure to remit the tax as and when due a misdemeanor punishable by a fine of not more than $500, and adds a 5% per month penalty where an audit reveals that false information was filed. Payments go to York County Treasurer, Hospitality Tax, PO Box 116, York, SC 29745; the Finance Office answers questions at (803) 684-8528.

Food Service Establishment Fats, Oils and Grease (FOG) Discharge Permit

County Code §52.80 aims to keep fats, oils and grease out of "the county wastewater system", and makes food service establishments and other commercial establishments generating wastewater containing fats, oils or grease subject to its requirements. It defines a food service establishment as one primarily engaged in preparing, serving or otherwise making food available for consumption using activities such as frying, baking, grilling, roasting or toasting, or any other preparation that produces a hot, non-drinkable food product in or on a receptacle requiring washing. Section 52.80(C)(1)(g) states: "All FSEs must have a permit setting forth terms and conditions of compliance with this section and the FOG policy. Permit fees are required as set forth in § 52.81." This applies to food service establishments that discharge to the county wastewater system. Under §52.81 (Ord. 119, passed January 7, 2019) the annual grease discharge permit fee is $0.00 and the variance fee is $0.00, and re-inspection (violation) fees are $250.00 for the first and $500.00 for each successive one. Section 52.80 also requires a written record of grease interceptor maintenance to be kept for three years. The county's FOG Program page links the Food Service Establishment Fats, Oils and Grease Discharge Permit Renewal Application for permit renewals.

Certified Food Protection Manager

No state fee, because South Carolina neither examines nor certifies anyone — the certificate comes from a nationally accredited programme at that programme's price. There are two obligations here and the second is the one that shapes rotas. At least one employee with supervisory authority, the power to direct food preparation and enforce health policy, and a frequent presence at the premises must be a certified food protection manager. Separately, at all times during operation the person in charge must be either a certified food handler or a certified food protection manager — which is a staffing constraint on every shift, not a one-off qualification for the owner. The rules draw a sharp line between certification and training: a training certificate alone does not satisfy the requirement, because the accreditation must attach to the examination process. Establishments the department judges to pose minimal risk are excused. No validity period appears anywhere in South Carolina's rules, so the certificate lasts as long as the issuing programme says it does.
