What do these permits involve in Essex County?
County Planning Board Site Plan and Subdivision Review Fees (Including the License to Connect to the County Stormwater System)
These are the fees the Essex County Planning Board charges for reviewing a site plan or subdivision application, as set out in Essex County Code §44-7, an adopted ordinance whose schedule was last amended on 2-11-2009 by Ordinance O-2009-00005. A business building, expanding or reworking a site in Essex County, usually through its contractor or engineer, pays these fees when its application goes to the County Planning Board; the Board's office (973-226-8500 ext. 2580) can say whether a particular project is subject to County review. The same schedule prices a license to connect to the County's stormwater system at $400 per connection. The nonresidential site plan row is reproduced exactly as the code prints it. Per §44-7, payment is by cash, check or money order payable to the Essex County Planning Board, and application fees are nonrefundable. After filing, the Board may send an application to consultants at the applicant's expense; the applicant is told the amount and may object within seven days, pay, or withdraw the application.
Fee for Installing and Maintaining a Sign on an Essex County Road or Right-of-Way
This applies only to a business that installs and maintains a sign on an Essex County road or within a County road right-of-way; a sign outside the County road right-of-way is outside this record. The figures are those in Essex County Code §44-25, an adopted ordinance (Ordinance O-2012-00009, adopted 5-9-2012), which sets the County's schedule of fees for the installation and maintenance of signage on County roads and rights-of-way. Under §44-26, the County Engineer may require the applicant to post a surety bond or cash bond to secure proper restoration of County roads disturbed by the applicant, and under §44-27 the County Engineer requires the applicant to agree to indemnify and hold harmless the County of Essex against claims arising from the installation or maintenance of the sign. Contact the Department of Public Works at 973-226-8500 (County Engineer ext. 2660).
County Road Opening Permit (Work in an Essex County Road Right-of-Way)
This applies to a business, usually through its contractor, whose work opens an Essex County road or otherwise takes place in a County road right-of-way under Chapter 44 of the Essex County Code. Essex County Code §44-14, an adopted ordinance, adopts the "Road Opening Specifications and Fee Schedule for Construction in the Essex County Road Right-of-Way" dated September 2009 and all of its provisions, and §44-15 directs the Director of Public Works to print that document with the ordinance and supply a copy to each applicant. The permit fee is therefore the amount in that September 2009 schedule, which is not among the documents published with the County Code on ecode360; contact the Department of Public Works at 900 Bloomfield Avenue, Verona (973-226-8500; County Engineer ext. 2660) for the current amount. Under §44-2, the County Engineer may require a permittee to post a surety or cash bond to secure proper restoration of the County road.
