Benton County, Arkansas, seat Bentonville; population 321,566 (U.S. Census Bureau vintage-2024 county estimate). These records cover unincorporated Benton County. The county Planning Department's FAQ states: "If your property is within the municipal limits of a city in Benton County, that respective city's planning department would have jurisdiction over your property. Benton County's jurisdiction lies in the unincorporated areas, or outside of city limits." The same FAQ adds: "Each city has regulations, permits, and rules regarding what can be done with and on property which can differ from city to city and from our regulations as well." The Benton County Road Department issues driveway permits for access to county roads. Food service, on-site wastewater, alcohol and contractor licensing are Arkansas state programs listed on the Arkansas state page.

What do these permits involve in Benton County?
Commercial Building Permit, Plan Review and Certificate of Occupancy (unincorporated Benton County)
The county Building Safety Permits page states: "Benton County currently requires building permits for all new commercial development within unincorporated Benton County." The same page adds that "all commercial development must receive the approval of the County Planning Board before construction begins." The fees are set by Benton County Ordinance O-2024-62 (adopted November 21, 2024), linked from the Building Safety fees page. Article 1 sets the building permit fee by total cost of construction, using the ICC Building Valuation table dated February 2024, in the tiers shown in the fee formula, copied from the ordinance text; Article 2 adds a Plan Review Fee of $50.00 for commercial or industrial buildings only and a Re-inspection Fee of $50.00. The fees page repeats the $50 plan review fee for commercial projects and states that online card payments carry a 3% fee. The Commercial Permits page says projects "typically start with the applicant attending a Developmental Review Committee Meeting", followed by Building, Planning and Fire plan reviews that typically take ten business days, with no expedited reviews. Planning Board approval, if applicable, comes before submission, and the submission list includes an Arkansas Department of Health plumbing approval letter, an approved septic permit if applicable, a "Contractor License", and stamped plans for projects valued over $250,000 (A.C.A. § 17-15-302, as stated on the county page). A Planning Commercial Final Inspection precedes the final building inspection; the certificate of occupancy is released after all final inspections pass, and the page states that nothing may be moved in before the final building and fire inspections.
Site Plan Review (Benton County Planning Board)
A business developing a commercial site in unincorporated Benton County goes through site plan review before the Benton County Planning Board. The county Planning FAQ states: "All other commercial uses require a Site Plan Review". The fees are set by Benton County Code of Ordinances §54-5 (Ord. No. O-2014-07, arts. 1, 3, 2-27-2014), which the FAQ names as the Planning fee schedule: $300.00 for all other development, $100.00 for construction with a GFA of up to 250 sq ft or a parking area with five spaces, $100.00 for a minor modification and $300.00 for a major modification. The county's Site Plan Review application ("Application Fee – $300") and checklist ("Payment of $300 fee"), both last updated March 2025, print the $300 figure of the all-other-development tier. Both forms state that the applicant reimburses the county for third-party consultant fees under §2.8 of the county's Planning and Development Regulations. The application is heard at a public hearing before the Planning Board. The Building Safety Permits page states that "all commercial development must receive the approval of the County Planning Board before construction begins."
Stormwater Permit (designated MS4 urbanized areas of Benton County)
A county Stormwater Permit applies only to construction in the County's designated MS4 urbanized areas. The county Storm Water page states that the requirements "apply to construction sites located in certain urbanized areas of the County that have been designated as MS4's", and that "All construction activities within the designated areas ... require a Stormwater Permit prior to the starting any construction activity on-site". The fee is $50.00 per plan for a total project area of 1 acre or less and $100.00 per plan for more than 1 acre, plus any County Engineer costs as an additional fee, as published on the Storm Water page; Benton County Code of Ordinances §54-5 (Ord. No. O-2014-07, arts. 1, 3, 2-27-2014) sets the same $50.00 and $100.00 figures. The page also lists a Stormwater Pollution Prevention Plan, an erosion control plan and, if applicable, a grading and drainage plan where construction will disturb 200 square feet or more. Apply on the county's Stormwater Permit Application, linked from both the Storm Water page and the Planning applications page.
