About each permit

Scrap Tire Generator Permit

Ordinance 2022-8 defines a scrap tire generator to include retail tire dealers, retreaders, automobile dealers, automobile salvage yards, private company vehicle maintenance shops, automotive repair garages, service stations and motorcycle or ATV retail or repair shops, but not households or beneficial agricultural operations. Section 14-503 states that no scrap tire generator "shall be allowed to operate a business within the unincorporated portion of Bernalillo County" unless it has an operational scrap tire cutter on the premises, a valid written agreement with a scrap tire hauler, or qualifies as a self-hauler; storage must not harbour disease vectors or pose a fire risk. Section 14-504 has the county issue a non-transferable scrap tire generator permit to any applicant meeting the ordinance, and the permit runs for one year. Section 14-507 states: "The County will establish an annual permit fee schedule by resolution." That resolution is not published online; the county's current Scrap Tire Generator Permit Application, linked from its Managing Used and Scrap Tires page, states "Scrap tire fee is $45.00" and that "Scrap tire permits are valid for one year once approved". Changes to the application must be reported within ten calendar days. Contact: Health Protection, (505) 314-0310.

Food Establishment Permit (fixed establishments, mobile units and pushcarts)

A restaurant, coffee shop, convenience or grocery store, caterer, child care kitchen, food truck or pushcart in the area served by the county's Health Protection team needs a county food establishment permit. The county Food Code (County Code Chapter 42, Article IV, Division 5) adopts the 2022 FDA Food Code with local amendments, most recently by Ord. 2023-23 (September 26, 2023). As amended, 8-302.11 requires the application at least 14 calendar days before the planned opening; 2-102.12 requires that "At least one employee per food establishment that has supervisory and management responsibility and the authority to direct and control food preparation and service shall be a certified food protection manager"; 8-303.20 renews a permit after an invoice statement is approved, the renewal fee is paid and the latest inspection shows compliance; and 8-303.21 issues a new owner's permit after application and inspection. The Food Safety page states that the team regulates "approximately 500 food service establishments in the unincorporated area of Bernalillo County" and inspects them one to three times a year by risk category. Fees: new food service establishment $200.00; renewal 0.003 times the previous year's gross receipts, at least $200.00 and at most $700.00; bars/taverns $100.00; self-contained mobile unit $120.00; non-self-contained mobile unit or pushcart $75.00; variance application $50.00. The figures are from the county's current Food Establishment Permit Application (footer "Effective as of 2023"; uploaded May 29, 2026), which the county's Food Safety page links as its Food Permit Application. The county Food Code provides for "the issuance of permits and collection of fees"; the fee resolution that sets these amounts is not published online, and the Food Safety page says to call (505) 314-0310 for fee information.

Temporary Food Event (TFE) Permit

A vendor selling, preparing or sampling food or drink at a temporary event in the area served by the county's Health Protection team files the county's Temporary Food Event (TFE) Application. The application states: "Application is due no later than 14 days prior to the event!" It asks for the event name, location and set-up time, the operator and on-site person in charge, whether the event is indoor or outdoor, the facility type (booth, mobile unit, permanent building or food cart), and every menu item with whether it is prepackaged, prepared on site or prepared elsewhere; it notes that any TCS foods are prohibited from being prepared at home, that inspections will be conducted after the event set-up time, and that a mobile unit or food truck must include a copy of its current food permit. Applications go to Bernalillo County Health Protection, 415 Silver Ave. SW, 2nd floor, Albuquerque, (505) 314-0310, HealthProtection@bernco.gov.

Swimming Pool Operating Permit and Annual Inspection Fee (group 1 and group 2 pools)

A fitness studio or club that operates a pool open to members or the public needs a county pool permit; a studio without a pool has no pool permit. County Code § 42-593 states: "No person shall operate or maintain a group 1 or group 2 swimming pool unless he has a valid permit to operate such a pool from the environmental health authority," and "The permit shall remain valid until otherwise revoked for cause"; permits are not transferable to another person or location. Group 1 covers pools open to the general public, with or without a fee, including pools run by clubs; group 2 covers pools that are part of a hotel, motel, apartment house, camp or similar establishment. Under § 42-595, "Each group 1 and group 2 swimming pool operator shall pay a $75.00 inspection fee to the county. All inspection fees shall be due on March 1 of each year." Section 42-592 requires plans and specifications to be submitted before a pool is built or substantially altered. The county's Swimming Pool Permit Application asks for a $75.00 check and the certified operator's name and certificate number, and the Public Swimming Pools page states that "All public swimming pools must be operated by a certified pool operator." NMED's April 26, 2021 release states: "NMED does not conduct inspections at public pools in Bernalillo County and Albuquerque, which administer their own pool safety programs."
