About each permit

Food Establishment Permit (Annual)

Madison County Code §55.15(A) makes it unlawful to operate a food establishment within the county without a valid permit issued by the County Health Department, so a restaurant, coffee shop, grocery, convenience store or daycare kitchen inside a city or village holds this county permit as well as one in unincorporated territory. The permit must be posted where customers can see it and is not transferable to another person or location. Establishments are placed in risk categories (§55.22) and the fee is set by category in Chapter 55 Schedule "A". The county's posted Food Sanitation Ordinance, which the Plan Review page links as "Sanitation Ordinance & Fees", states: "Fees will increase on odd numbered years at a rate of 5% rounded to the upper tenth dollar." The current amounts are not published on a county page or form; contact the Health Department for the figure that applies. The permit runs 12 months from issuance (§55.17), and renewals are paid through the Health Department's Food Establishment Payment page.

Mobile Food Establishment Annual Service Permit

Code §55.15(A) requires a Health Department permit for any mobile food establishment operating within Madison County, in cities and villages as well as unincorporated areas, and the permit must be posted so it is clearly visible to customers. The Health Department's Plan Review page states that the operator of a mobile food establishment must have a base of operation from a permitted facility, and that the Use of Commissary Agreement "is required before a permit will be provided." The fee is set in Chapter 55 Schedule "A"; the county's posted Food Sanitation Ordinance states that fees increase 5% on odd-numbered years, and the current amount is not published on a county page or form, so contact the Health Department at 618-692-8954. The permit runs 12 months from issuance (§55.17).

Temporary Food Service Establishment Permit

The Health Department's Temporary Food Service page states that every food stand operating at a publicly advertised single event or celebration in Madison County needs a Temporary Food Service Sanitation Permit, and that "This permit does not cover birthdays, weddings and other private events. A year long permit is needed to sell food or beverages at private events." The fee is $75.00 per event, as listed in Chapter 55 Schedule "A" (effective December 1, 2018) and on the Health Department's current Temporary Event Food Service Application. The application is due at least 14 days before the event; one received less than 48 hours before the event costs $150.00, including a $75.00 late fee. The form states: "A Temporary Permit IS required for Annual permit holders (no fee)." A temporary permit lasts no longer than 14 days for a single event (§55.17).

Food Business Plan Review

The Health Department's Food Sanitation Program page states: "Before a health permit is issued, every new or extensively remodeled facility must undergo a plan review process." The plan review fee is $200.00, as listed in Chapter 55 Schedule "A" (effective December 1, 2018) and on the Health Department's current Food Business Plan Review Application ("Amount Paid: $200.00"). The application form states that a plan review application is void if construction has not commenced within one year after the date of issuance. The Plan Review page lists the applications by category and asks first-time applicants to call 618-692-8954 before starting; after processing, the applicant receives a letter, the permit application and payment instructions.
