Authorization to Cut or Dig in a County Road or Right-of-Way (Craighead County)

A contractor who needs to cut or dig in a Craighead County road or its right-of-way, for example to run a utility line to a new business site, must first obtain authorization from the County Judge or his representative. Craighead County Code §1200.02(5), part of the Code of Ordinances enacted by Ordinance 2022-007 (filed March 1, 2022), states: "It shall be unlawful for any person to cut, dig or otherwise deface a county road or right of way for any reason, without first obtaining authorization from the County Judge, or his representative of the County of Craighead, State of Arkansas, who, when necessary, shall require the posting of a bond in the amount sufficient to cover the estimated cost of repair or damages." The section's source note cites Ord. 1977-016 (passed 04-11-1977), amended by Ord. 1990-018 and Ord. 1995-017. Code §1200.02 sets no fee; when the County Judge requires a bond, the bond is security for repair or damages, not a fee.
