Business licenses and permits in Waukesha County, Wisconsin
Waukesha County, Wisconsin, seat Waukesha, licenses retail food establishments (fixed, mobile, service base and transient) and public swimming pools countywide through the Department of Parks and Land Use, Environmental Health Division, acting as the agent of the Wisconsin Department of Agriculture, Trade and Consumer Protection under Enrolled Ordinance 173-093; the DHS directory lists one local health department for the county, and under Wis. Stat. §97.41(5) and §97.615(2)(e) each license fee includes the State fee. Those health licenses apply inside the cities too: the county's inspector coverage sheet assigns staff to all seven cities (Brookfield, Delafield, Muskego, New Berlin, Oconomowoc, Pewaukee and Waukesha). Health fees are set by the Division within the limits of the annual county budget (County Code §14-413(a)). The county's Planning and Zoning Division zones only a defined area; its FAQ says: "The County's jurisdictional area includes all of the Village of Lac La Belle and the Town of Ottawa, and includes Town of Oconomowoc (islands), as well as the Shoreland and/or Floodland areas (1,000 feet from a lake or pond and/or 300 feet from any other navigable body of water - streams, ditches, etc., or the floodplain whichever is greater) of the Towns of Brookfield, Delafield, Eagle, Genesee, Merton and Mukwonago. The County's zoning jurisdiction does not include cities or villages." The Land Resources Division issues stormwater permits on unincorporated land unless a town adopts its own compliant ordinance (§14-331(a)). Retail alcohol licenses are municipal: Wis. Stat. §125.51(1)(a) lets every municipal governing body issue Class A and Class B liquor and Class C wine licenses, and §125.26(1) does the same for Class B beer licenses. County Code §14-576(a) refers to "building permits issued by a city, village or town". The county's 2024 Municipal Directory lists 7 cities, 22 villages and 8 towns; each runs its own licensing and building permits, and outside the county zoning area its own zoning, all of which stack on the county records here. The population figure of 417029 is the U.S. Census Bureau's 2024 estimate.

What do these permits involve in Waukesha County?
Preliminary Site Evaluation (properties on a private septic system)
The county's septic systems page says: "A Preliminary Site Evaluation (PSE) is required prior to the issuance of a zoning and/or building permit on properties served by a private sewage system." For a business, the relevant line on the county's Environmental Health fee schedule page for 2026 is usually the $87 evaluation for an increase or change of use of a commercial building; additions without a use change are $72 and accessory structures $56. The evaluation is done by the Environmental Health Division under County Code §14-588 and comes before the municipal or county building or zoning permit. The requirement is tied to properties served by a private sewage system.
County Zoning Permit (county zoning jurisdiction only)
This permit applies only inside the county zoning jurisdiction. The county's Planning and Zoning FAQ says that area "includes all of the Village of Lac La Belle and the Town of Ottawa, and includes Town of Oconomowoc (islands), as well as the Shoreland and/or Floodland areas" of the Towns of Brookfield, Delafield, Eagle, Genesee, Merton and Mukwonago; the Zoning Code page says the code applies to the Town of Ottawa and the Village of Lac La Belle. Elsewhere, the city, village or town zones. Zoning Code §3.03(1) requires zoning and occupancy use permits before construction and "before any change is made in the type of use". The amounts are from the Planning and Zoning Division's page headed "Planning and Zoning Permit Fees - 2026"; under Zoning Code §22.02(5) the fees are "established by the annual Waukesha County budget adopted by the Waukesha County Board". The page also lists a $425 floodplain annual utility permit. The 2027 Executive Budget states no zoning rate change.
Site Plan / Plan of Operation Approval (county zoning jurisdiction only)
A business establishing or changing a commercial use inside the county zoning jurisdiction (the Town of Ottawa, the Village of Lac La Belle, the Town of Oconomowoc islands and the shoreland/floodland areas of the Towns of Brookfield, Delafield, Eagle, Genesee, Merton and Mukwonago, per the county Planning and Zoning FAQ) goes through site plan / plan of operation review by the Planning and Zoning Division. The fee is $310, or $155 for a minor change, as listed on the Division's page headed "Planning and Zoning Permit Fees - 2026"; Zoning Code §22.02(5) puts the fees in the annual county budget. Outside that area the city, village or town handles site plan review under its own code and fees.
Conditional Use Permit, Board of Adjustment and Zoning Amendment Petitions (county zoning jurisdiction only)
Inside the county zoning jurisdiction (the Town of Ottawa, the Village of Lac La Belle, the Town of Oconomowoc islands and the shoreland/floodland areas of six towns, per the county Planning and Zoning FAQ), a use that the zoning district allows only as a conditional use needs a conditional use permit, a request to depart from the code's standards goes to the Board of Adjustment, and a change of district needs a zoning amendment. The fees are listed on the Planning and Zoning Division's page headed "Planning and Zoning Permit Fees - 2026": $650 for a conditional use with a plan of operation, $600 without, $645 for a zoning amendment and $750 for a Board of Adjustment petition. Zoning Code §22.02(5) puts the fees in the annual county budget. Outside the county zoning area the municipality decides these petitions.
Sanitary Permit (Private Onsite Wastewater Treatment System)
A business whose premises are served by a private onsite wastewater treatment system (septic system, mound or holding tank) needs a county sanitary permit from the Environmental Health Division before installing, replacing or reconstructing the system. The figures are those on the county's Environmental Health fee schedule page for 2026; County Code §14-580 says the fees are those "identified in the Sanitary Permit Fee Schedule posted at the Department" and are set and adjusted annually through the county budget. Under Wis. Stat. §145.19(3), a portion of the permit fee is forwarded to the State. Wis. Stat. §145.19(6) provides for a $25 State groundwater fee for each sanitary permit; the county fee schedule does not state whether that $25 is included in the amounts shown, so contact the Environmental Health Division (262-896-8300). The 2027 Executive Budget expects a septic permit rate increase of approximately 6%, which the County Board considers in November 2026.
