Highway Opening and Use Permit (Work or Storage in the County Right-of-Way)

Resolution L-45 of 12/30/2015 requires a Highway Opening and Use Permit from the Division of Roads for openings, driveway and roadway access work, storage and other work in the county right-of-way. Section IV of the resolution states that fees, bonds and insurance apply as stated in its Section X fee schedule, and that fees may be increased by up to 5% on each third anniversary of the resolution, beginning March 15, 2019; contact the Division of Roads at (973) 881-4500 for the permit fee in effect. The County Engineer's Right-of-Way Access Permit form states that a two-year $5,000.00 maintenance bond must be posted for a driveway ($10,000.00 if the road has a concrete base or has been resurfaced in the last 7 years), and that proof of insurance must also be submitted. The application form (ROAD-HWYOPENAPP) states that work must start within five working days of issuance or the permit is void, that a project exceeding 30 calendar days must renew the permit, and that no work other than valid emergencies takes place on county highways from November 15 to April 1.
