About each permit
Biennial Club and Drinking Establishment Tax (unincorporated Shawnee County)
A restaurant or bar holding a Kansas club or drinking establishment license for premises in unincorporated Shawnee County pays the county a biennial license tax. K.S.A. 41-2622(b) provides that, in addition to the state license fee, the city where the licensed premises are located or, for premises outside any city, the board of county commissioners of the county may levy a biennial occupation or license tax of not less than $200 nor more than $500. Shawnee County Code §4-3 levies it on entities doing business in the unincorporated areas of the county at $200 for a Class A club, $500 for a Class B club and $500 for a drinking establishment. The tax is paid to the County Clerk, deposited in the county general fund and is non-refundable; violations carry a civil fine of $1,000 and are reported to the director of the Alcoholic Beverage Control division of the Kansas Department of Revenue. Premises inside a city pay that city's tax instead, under the same statute.
Cereal Malt Beverage Retailer License and Special Event Permit (unincorporated Shawnee County)
A restaurant, coffee shop, store or food vendor selling cereal malt beverages at a place of business in unincorporated Shawnee County applies to the Board of County Commissioners through the County Clerk's office (Shawnee County Code §4-26). The County Clerk's Licenses page states that its cereal malt beverage information "is for those businesses located in the rural parts of Shawnee County. Any place of business within the corporate limits of any city should contact that City Clerk." Under §4-25 (Charter Resolution No. 1987-2) the county is exempt from the fee provisions of K.S.A. 41-2702(d) and (g) and the Board sets its own fees. Section 4-26(4) sets them at $50 per calendar year for a license to sell in original and unopened containers, not for consumption on the premises, $200 per calendar year for a license for consumption on the premises, and $50 for a special event retailer permit. The full license fee is due whatever the month of application, and the license covers only the rest of that calendar year (§4-26(5)). No more than four special event permits are issued to one applicant in a calendar year, each for no more than 30 calendar days. Resolution No. 2025-66, adopted September 8, 2025, provides that from September 1, 2025 each licensee or special event permit holder must also buy a $25 state CMB stamp from the Kansas Department of Revenue to affix to the license or permit; that $25 is a state fee, not a county one. The County Counselor's memorandum on the resolution explains that the 2025 Legislature amended K.S.A. 41-2702(e) to move the stamp to the Department of Revenue. A business inside a city applies to that city.
Tobacco Paraphernalia and Novelty Items Retail License (unincorporated Shawnee County)
A store in unincorporated Shawnee County that sells tobacco paraphernalia and novelty items at retail needs a county license for each premises (Shawnee County Code §7-28(a)). Section 7-27 defines the items as objects used, intended for use or designed for introducing tobacco into the human body, such as tobacco smoking pipes, rolling papers, tobacco or cigarette rollers, and tobacco or blunt wraps. The application is made at the County Clerk's office with a $500 fee; the applicant swears to being a U.S. citizen at least 21 years old without certain convictions in the previous five years. The Clerk decides within 30 days and refunds the fee on rejection. Each license is effective for one calendar year from issuance; renewal is by reapplication no more than 30 days before expiry, with a $500 license fee. The license is not transferable and must be displayed at the premises. The County Clerk's Licenses page lists the tobacco/novelty paraphernalia retail license act among its licenses.
